How would Matt feel if I used his images with my buddies soundtrack to it. then put it on a website without permission. Plus we all know the power of music in film. It tells us how to feel. That is why they give Oscars for it. Without such a great song would his images have the same impact?[/quote]

If he createed a subpar video out of thie Alanis song.. no one would really bring up the permission issue. But since it's a very well done video, question spawns about persmissions he's received. As if a written permission has any correlation at all with how well his video+song combo. Sure.. you can make a valid argument that a significant portion of how well his video turned out(as an entire finished product)  has the song to thank for, but you sir seems to be leaning on the argument that because he was sneaky enuff to picked a good song to make a video to, we shouldn't give him as much credit as we are right now. Perhaps you'd be happy if we had prorated our rating of how good he is?

Re: WOW Look at this kids work!

I personally could give a flying **** whether or not Matt has permission in only that I want to know if I need to be concerned with my own projects and what capacity I can 'show' them.

Something tells me there are no worries, but now its matter of curiosity for me. The song is kickin and really works, but I have supported Matts work purely on aesthetics and not how it sounds.

Yeah no ****.. good point.. i don't know what prompted elvis to bring up his futile "copyright"(dare i say trollish?) argument...

Re: WOW Look at this kids work!

Art is Art! And it should all be protected. I only brought it up because Matt said at his site to respect his rights! What about the rights of the song writer. If you had something that brings in royalties you might feel a little differently. 8)

Re: WOW Look at this kids work!

Brett.. I am glad Matt cleared up the DOF issue, and sorry you didnt believe me when I told you it was possible.

And to say that DOF and rack focus is apples and oranges.. well... maybe you should take that filmaking 101 course you mention.

It seeme you are really sold on your mini35... Its a great tool, no question about it, but you can get some great DOF with the stock lens.

Re: WOW Look at this kids work!

You cannot execute a rack focus without shallow DOF. The one requires the other. Trying to execute a rack with deep DOF would be an exercise in futility.

So when Jarred said "the rack focus in the shower", it should be obvious that he's using the term to establish which shot he's referencing, and the DOF in that shot is obviously (and necessarily) quite shallow (else you could not rack between one spigot and the other). And Jarred's wealth of experience should garner him the benefit of the doubt on the subject anyway.

As for the copyright issue, whether you try to sell something or not, you can't reproduce someone's copyrighted work without permission from the copyright owner. That's what the law says. You also cannot exceed the speed limit -- that's what the law says.

Drive 5mph over the speed limit, and nobody will care (except all the guys behind you, trying to go 15 over, and you're blocking their way). Try driving 120 down I-15 from Vegas to L.A., and you'd better believe they'll stop you. Both are speeding, both are illegal, but there's a threshold past where someone starts to sit up and take notice.

So if anyone, anywhere, will get upset over this particular infringement is really up to Alanis and her record company. If they don't mind, there's no issue. I mean, yes, there would technically be an infringement (actually I'd suspect this would come under the heading of "derivative works", and the rights to create derivative works vest with the copyright holder) but does it matter? Do they care? That's between Matt and Alanis.

Yes, we should all respect copyright holders' rights. Nobody's saying we shouldn't. Just, don't get all worked up about it and divert the thread into another "can I use music" thread... there are already approximately six hundred million threads like that on the Internet, all at Google's fingertips for anyone who wants to read up on it.

Matt, if you want, you could send a link to Alanis' fan club and ask her to watch it and to grant permission for you to use it. I bet she'd grant it, and be flattered. For all you know, she might put a link up on her site, and you'd get instant fame and maybe even rewarded for all your hard work by someone seeing it and wanting you to do a video for them.

Paramount is famous for copyright enforcement, stamping out Star Trek fansites, etc. George Lucas used to be as zealous, but recently had a change of heart and started endorsing fan films, even made some official sound effects available and actually held an officially-sponsored fan film contest. So enforcement, permission, that type of thing -- that's between those two parties, and we shouldn't get all worked up about it. If they don't like it (like Paramount) they'll shut him down. If they don't mind (like George) they'll let him go.

Re: WOW Look at this kids work!

First order of business: Matt, your work is the **** and totaly inspiring. You rule, and you just made a sale for Panasonic.
Second: Hi, my name is Zac and this is my first post. I've been looking into getting a DVX camera, and Matt's videos pretty much sold me! I was wondering though, where can I find a good film 101 website or book? I've been doing videos for a year or so, shooting on a crappy digital camera and editing with Magix Video Delux. I've read every reply under this thread to try and figure out how Matt achieve such a beautiful look in his film, but I don't understand a lot of things like DOF, racks, post, and a handful of other terms I've come across in this thread. Where do you learn all that junk? =) Anyways, this is an awesome forum, thanks in advance for you help! Oh yeah one more thing. I want to learn a new NLE (booya, there's one new term I got from this site) because Magix is just a bugged-to-hell program and isn't top notch anyways. I'm leaning towards Premier or Vegas. Toss me a good arguement for either one if you would be so kind =)
Thanks again!

Re: WOW Look at this kids work!

Thanks Barry.. as usual your right on the money.

ASCAP acknowledges that artists use copyrighted music in their demo reals, and is a Grey area, it is illegal but the admit to not pursuing action, except for some extreme cases where they simple send a cease and desist.

And Nick, as for saying it is a copy and a complete rip-off.. well I haven't actually seen the alanis video for this song, in fact I don't even think there is one (I could be wrong, I'm not a loyal Alanis Follower). But to say it is a unoriginal.. we can say the same about Art History, and pretty much every single other piece of work on this board and out on broadcast.

Re: WOW Look at this kids work!

Welcome Zac.. you should sign up as a member, you will gain a buncha features.

Maybe Panasonic should sponsor Matt, if he just convinced you to buy a camcorder :)

And for links to 101 stuff. let me suggest instead bookmarking this page:

http://homepage.newschool.edu/~schlemoj/film_courses/glossary_of_film_terms/glossary.html

its a dictionary of terms you can goto if you dont understand something, and is described pretty well. for example, DOF brings up this explanation:

While a lens focuses on a single plane of depth, there is usually an additional area in focus behind and in front of that plane. This is depth of field. Depth of field increases as the iris is closed. There is more depth of field the wider the lens and less the longer the lens. There is a deeper area in focus the further away a lens is focused than there is when a lens is focused close. Depth of field does not spread out evenly; the entire area is about 1/3rd in front and 2/3rds behind the plane of focus. To factor together all these variables it is best to consult a depth of field table, such as the ones found in the American Cinematographer’s Manual.

Re: WOW Look at this kids work!

Well put Barry. Damn, the voice of reason. I love it.

And Zac, if you are looking for a good filmmaking 101 site just ask Brett.

(I had to. I couldnt resist. It was like a big red button with a sign that says DO NOT PUSH. I just had to.)

Re: WOW Look at this kids work!

Geez, so much "controversy" over this stuff, eh?

Bottom line is, Matt's music video work is great. (would like to see how he handles a script based narrative with actors however, as they're two VERY different worlds).

Anyway, I wouldn't be concerned with legal issues on stuff like this. No copyright holder will bother with Matt's online reel stuff because he's not making money off of it. In fact, what he and other "fansites" have done over the years is help promote the bands (or movie/tv properties) at no cost to them thus expanding the financial lifespan of said band or property.

At the very worst, if some copyright holders lawyers was quitting smoking that day and wanted to get pissy about it, they'd send a cease and decist order to Matt and that would be the end of it. (unless Matt didn't take it down AFTER receiving the notice). There first has to be notification though.

Odds are, even if he didn't take it down, nothing further would happen to Matt as they wouldn't want the bad publicity of a big corporation going after a talented teenage director who is simply showing his love for the bands music and what he's capable of as a film maker. It wouldn't be worth it to them.

Looking forward to future work from you Matt.

ahem. odd you of all people would choose to take this debate to this level.

a few things here - never said it was a "copy or a complete rip-off" - more specifically didn't say it was even unoriginal 'because' of the original video of the song.
I have never even seen the original video of the song nor do I know if there is one.
[read my post...]

I have however seen MTV. and when you make a piece of work that looks like (in lots of ways - except for the small problems in it) most of the work on MTV then you make something unoriginal.
do you deserve to be congratulated for learning how to do this at age 17...sure...learning software to that degree at any age deserves some credit. (my mother - who is 63 - can write a pretty good formal letter with Microsoft Word) I hope it's clear from my posts that I was agreeing with that.

The piece of the puzzle that Jarred's missing here is that it is a question of what one ASPIRES to. If all you aspire to is to duplicate then hey - give the kid a gold medal at the Video Special Olympics. If you aspire to actually break new ground...then go and do something else.

As to the argument about pure originality of anyones work - that particular tired philosophical debate is one (in my opinion) best not dragged into a board of this nature - however if you really want some links to lofty discussions on this matter I'd be happy to supply them.

You know me well enough to know that I criticise myself first then others.

Nick

Re: WOW Look at this kids work!

I'm seeing alot of this in here: "Teacher, teacher, you forgot to give us homework!"

My bottom line: Matt- great work.

Theory: Who didn't make fake music videos growing up? I know I did. All the time. That doesn't make you any less creative. Shoot I was making them when I was 13 in my bedroom with an old school betamax. As to the licensing, legalities, etc... Barry, you said it best.

We should be focusing on the cinematic/production values of Matt's work, since that's what this place is all about. His using that song as a platform to excercise his talent and create his work is fine in my book. Sometimes you don't have a story or band or subject to do a piece on. If it's the difference between getting out and creating using the dvx vs it just sitting in a case, i'll take fake music videos anyday....

If anyone wants to go start a "musicuser.com", by all means do it....

Well I can answer that. The first two times I watched this it was on a comp with no sound card. I often watch shorts and even trailers on this comp intentionally since directing and editing is visual storytelling. If a director has done his or her job you should be able to watch the piece without sound and understand completley.

So to answer your question, when I started the thread here about Matt I had not yet seen it with the music. So yes, strong composition and editing are still equally impressive without the music.

nick's post 12 hours earlier:

"it's just entirely unoriginal.

meaning if someone 17 went out and painted a Monet exact replica what would people say - well people who can't paint well would say "wow" and people who can would say "cool - now go paint something original".

Nick, I keep re-reading your post and where am I supposed to be seeing that you don't say its not original and he didn't copy?

I watched this kids work and was in awe. From beggining to end its was a great piece of work. I find it odd you seem to be harping on the kid's "screenplay" and how unoriginal or mainstream or (What exactly are you saying again?). When this forum seems to be about looking how good work "looks".

So this 3 minute video assembly cut to music looks like a Music Video; isn't it supposed to?

Re: WOW Look at this kids work!

I wouldn't worry about anyone harping this kid's work. He clearly is good, and if people can't realize that, well it's their loss. This kid has gotten more than enough praise for his work, so realistically I don't think it really matters if there's one or two people who feel the need to find something wrong (real or imagined) with his work.

But he obviously is awesome; if it isn't original - and I'm not saying it's not original, but if it weren't - then at least it's a damn good 'copy'.

Also, Nickybee, it's a little mean to say:
if someone 17 went out and painted a Monet exact replica what would people say - well people who can't paint well would say "wow"
I dunno, seems like you're implying that most of the people on this forum "can't paint". Cuz most of us like this kid's work...
