dvx100 stolen from me

LAST QUESTION OF ADVICE:

Deciding whether to persue this on the legal end. This is what I have

1) Documentation that this person has frauded people in the same manner as myself.

2) The fake cashiers check (dont know what good it will do)

3) The website that was used to advertise my camera. Which was also used by
the criminals to fraud me out of my camera has a record of being black listed for shady deals. Perhaps i can get written documentation from them stating they have been involved in shady deals. They also have two different emails with different numbers that point to the same person.

4) All phony numbers lead to the same area where they reside.

5) I have seen with my own eyes the car that came meet with me to purchase the camera.

6) Receipt that i purchased the camera.

in your honest opinion how do you guys think i will fare in court?

It sounds like the people invovled have some type of crime ring going. You might benefit from contacting the other persons you mentioned that had been scammed. They might already have a case going you can piggyback onto or at least find out what they have done that is working for them.

I am not an attorney, so I don't know your chances. I suggest you call 3-4 local attorney's and talk with them. I know a lot of attorney's will not charge for the 1st 30 min. They will be able to give you some good advice.

Documentation is important. If you say something happened in court without documentation and the defendant documented his version of the event (even if his version is false) the court will give the documentation more weight. Write down or videotape yourself taking about everything, or just print this thread.

If you have no faith in the justice system and you have big balls... the options are endless.

Pimp - There are people that usually mediate these things that are found in you local paper classified ads or the yellowpages. They are "Debt Collectors" every neighbourhood usually has one or two.
Generally they are either:-

-Big Big Guy
-Big guy with gun
-Big guy with baseball bat
-Small guy with big balls and gun
-Small guy with big balls

They may eat as much as $500 of the amount owed - i dunno
but show him the docs and the cheque - give him the address and - voila!

presto magico! sometimes they work wonders.

Of course this is not without the inherent risks but under the circumstances in which you have not being given relief by the local authorities I would be tempted to take this to the next level.

Good Luck!

That posting is information for the thread starter so that he can gather up information on the scammer and his victims so that he can have a better case if he takes any legal action.

Can anyone provide me information for the member BPTE

He got ripped off my the same person as i did. i want to get as many people as i can get to go after these criminals

i would have a friend sell another camera as bait and have this dick make an offer. he agrees and they meet for the exchange. so when you spot him let him have what's coming to him.

If the scammer has googled himself, he would have come across this thread already. But doesn't hurt to try.

Good point. Also, all you people advising him to go over to this guys house and take it back by force could be giving terrible advice. If this guy does indeed have a "crime ring" as suspected, be probably owne's a gun. Take one step into his house without his permission, and he has every right to shoot you on the spot... and get away with it, too.

I just spoke with someone from the california attorney generals office. And they were complete @$@#$. Basically they told me it was my fault i got robbed and its not the problem of any of the law enforcement agencies. He didnt want to hear about me having information on the criminals. He said go to small claims court. Because its my word versus them.

What a @%$%#%$

have you contacted the District Attorney's office ?
they might have other complaints against person ?

back in 2000 i had bought a laptop from a Producer that i worked for in 96 ..
he lived 300 miles away ... i sent the $2000 and they sent me nothing ... when i told the producer that i was going to file a police report he laughed - told me his local police would do nothing and my police would do nothing !! he was correct .. oh and the producer was a X police officer ...
i called his city's district attorney's office - they said it was lo priority - they're so busy ... called again about week later and this time they transferred me to a DA - turns out the DA knew the Producer - he said he would call him that day ... within 30 min the Producer called me asking me for my address and i received $1800 the next day with a note saying they would pay other 200 by end of month ( never got the 200) ...
soooooooooo even if you know the person use caution ...

I already talked to the DA.

NO HELP

What the A.G. said is essentially correct. Since nobody witnessed the transaction, the burden is on you to prove it ever took place. The @$%@# that ripped you off could say you're the one in possession of the phony cashiers cheque and they never saw it before.

Their name isn't on it. As totally unfair as it is, they got you coming and going.

Hire a big Repo Man through a third party who you have paid to stay quiet. Let them get your camera back or the money equivalent from the lamo crooks who took it.......wait that isn't legal.......I never reccomended that......

Second option...hire a Ninja to sneak into the place and take pictures of your stuff, and sneak out. Then you will know exatly where to tell the Repo man to go.....wait...that isn't legal either........

Third option....look for their auctions online, have one of your friends "Buy the valuable item" and then give them back the fake cashiers check while keeping and selling the valuable item to get enough money to cover your DVX loss......hmmmm

Fourth option...watch the house like a stalker until you know their comings and goings, where they hide keys, windows left open, whether they have dogs, etc. When they go, and you know everything, go in and get your camera or something of equal value.

Fifth Option....Hire a Private investigator to build a case against them so the police have to act.

Lastly, stage a setup, since you know their pattern and catch them in the act. record everything on camera and "prove" it and then let the news media know.

Lastly Lastly, call all the news stations and tell them how no one is willing to help you. Put the heat on the police through the news media and they should do something.

Just food for thought. :Drogar-Evil(DBG):

That news station idea sounds good. They always have that on foxnews. Has anyone seen the recent video of the reporter getting attacked when they confronted the scammer and his wife?

Seriously man, just get some big guys (3-4) to go over to the house with you, and get your money/camera back...if not more.

That's what I said! Except it would be 3 to 4 guys who also brought a DVX or 2 to capture the whole thing.

Yeah,
sounds like you've been had. Don't be suprised that you're not getting help from the Po-Po. Best you can do is set them up like they did to you and film it or something. I like the idea about talking to local news about doing a little expose on their operation. Local news places love that stuff. Otherwise just do the small claims thing and deal with it.
I'd advise against storming the house or anything, unless you really know what you're doing in that respect or you'll end up hurt or in trouble with the law yourself.
If you must do something like that, then be smart and investigate thier schedule and whereabouts/ house for a while, and wait till thier gone and clear out enough of thier junk to make back your $.
Good luck, man
