How to avoid a bad situation (fraud)

This may be annoying to some but why not take this forum into the "real names" realm? I use my real name in my signature with a picture. If you go to my site my phone number is there. Is it such a big deal to use your real name? I know anonymity is great for scammers. All the sites now require real names. All the sites I am a member of require real names. It will not eliminate the problem but it helps. Just my two.

I agree. However, my guess is that there are a number of high/medium-profile pros on the board. Their ability to select who knows their real identity allows them to be frank about their experiences in the industry without fear of repercussion.

But, other than that, I am a fan of the real name idea.

I think names are a good thing also and would be happy to "upgrade". However, personal security is an issue, and it may not be for everyone. Whenever I do a deal, I get enough info to nominally identify the seller; phone number and a call, verified paypal address, etc.

When I purchase from a DVXuser, I do a search of all their posts and read a selection of them. You can get a pretty good idea where they are coming from by what they are interested in, how they interact and how engaged in the topics they are. A big red flag is all they ever do here is sell gear. I usually don't discriminate against folks with a somewhat limited posting history, but if they have infantile or flaming comments, I run the other way.

Recently, I queried someone regarding a gear trade and decided their gear was not what I wanted. The guy proceeded to call me twice on the phone trying to convince me to do the deal. He had a thick Brooklyn accent, talked over me in conversation, couldn't complete a sentence, and didn't think my concerns mattered. I hung up on him on the second call. Not my idea of good business.

Regards,
Grant

Any thoughts or problems on dealing internationally? Sorry that I'm naive, but where do you find reputable escrow companies to deal with?

Yes, international issues would be good to cover. I currently would like to know the best/least expensive method (including or avoiding customs) for selling to someone in Canada.

Yes, international issues would be good to cover. I currently would like to know the best/least expensive method (including or avoiding customs) for selling to someone in Canada.

Selling to Canadians is easy. It is the buyers responsibility to pay the duty and they taxes on the purchase. I buy internationally often and since I live in a city that is considered a port of entry to Canada I am able to clear the items through customs myself rather that using a broker. If you sell to someone in Canada, do the right thing, Include an invoice with the paper work, a description of the goods, and origin (where they were made) and give this to UPS or USPS or whoever you agree to use as a shipper. If someone wants you to lie or BS paperwork to avoid paying what is in most cases, Federal GST Tax of 5% I suggest you say no, lets just call it bad karma. In all of the things I have bought over the years from America and elsewhere, I have never been asked to pay "duty" but have ALWAYS paid the taxes due and never had any hassle. The only point I make to my fellow Canadians is if you can possibly act as your own customs broker do it. It is very simple, you get the documentation from your shipper, you go to customs and pay the taxes and return the paperwork the customs stamp to your shipper. They release the shipment.I believe this can usually be done if you live in a major city but is more difficult if not. It saves you considerable expense since a UPS broker fee for a $60.00 purchase could be half or more of the cost.

Seller/user "tampawolf" scammed me - never sent the lens, has not refunded. ignoring my emails.

Sorry for the bad copy and paste, working off my mobile phone.. I'm at a loss and don't know what to do. Anyone help me get a lawyer or someone who can get my money back?

Full thread of email conversation below.
Never resolved. Seller is ignoring my emails and will not refund my money.

Paid in full, asked for a tracking number, never provided. He claimed to have shipped it, with rush shipping after not shipping it on the day he was supposed to. It has been over 2 months and nothing has arrived. And he seldom responds to my emails.

See below for full correspondence. User should be flagged and blacklisted unless this is resolved to avoid any other people getting ripped off.

When you take 4 or 5 days to respond to an email and accuse me of being ridiculous and to blame, that is sketchy.

I put faith in you by paying upfront without having the item, and even covered all the costs around fees. I went put of my way to make sure you were taken care of and happy.

All I asked for was a lens and a tracking number.

I cannot say that I appreciate your efforts because this had gone on for well over a month. If you really cared to settle this you would have done so already rather then responding to my emails when you felt it was convenient for you and only after I was forced to send multiple emails hoping and praying for a response to know that I have not been ripped off.

Shooting overseas and locally to get my hands on a similar lens of this speed is not easy. I have to cover the money I lost to you and the money that I have had to pay for the rental.

When financing my own project right now that has multiple shoot dates, renting out of pocket adds up.

Anyways like I said, I don't want to keep your lens, even if it does magically show up. Which I find highly unlikely as you stated that you paid for rush shipping because you didn't ship it on time.

Show some respect back to me and please refund my money with the same faith and trust that I put in you.

It's obviously not that simple as I sent the lens. I'm currently trying to track it down as to make sure I'm also not being ripped off. For all I know you could have it, and want your money too? I'm not assuming that at all for what it's worth, it's a s*%tty situation obviously but I'm working on it, if I wasn't i would just ignore your emails and move on. As it stands I care about the community, and this type of thing is never good for anyone involved. Ive been in the industry for a long time, if you have spent more on rentals than the lens is worth, you would be fine financially with the gigs you filmed using the rentals, makes me feel a little sketchy. Again though, I'm working on tracking it down.

A faster shipping method (that you claimed you used) if shipped on Monday should have arrived by last Friday as you stated.

Now you are claiming it will be here this friday? Thats nearly 2 weeks from when you shipped - hardly a faster shipping method that you claimed.

I hope you never encounter a seller like yourself and have to feel the same lack of respect I have felt.

Hey no issues with lens, I'm out but I will send you all the pictures tonight, and also mine as well upload them to my post. I would rather just do Paypal over xe.com because i'm not familiar with it. (Shipping was included but I also stated US only, so I'm bending that a little as well )

Hey Michael,

I thought shipping was included with the purchase?

I'll split with ya. Add $15 to the price.

To seal this, please see me some pictures of the front and rear elements and body/caps of the lens place a pen in the pictures.

Been burned in the past, this is my safety to make sure all is okay.

Do you have any issues or are there any concerns I should be aware of with the lens?

Thanks!

NEVER BUY USING PAYPAL GIFT!!!! It's like sending cash. It's worth requiring the sender to use "PAYPAL INVOICE"! That protects you as a Buyer! I don't care who the seller is on the forum and how long they've been on the forum. ALWAYS require PAYPAL INVOICES for buying transactions. Others may disagree............but I tend to lean towards being "SAFE" than "SORRY"............

If you didn't send as PayPal Gift, contact PayPal, they will eventually issue a refund!

ACCEPTING PayPal Gift is just as risky as sending it, to be honest.

PayPal now allows you to fund a PayPal Gift transaction with a credit card as long as the sender agrees to the fees, so...

1) Seller offers something pricey for sale, but doesn't want to pay PayPal it's 3%... so he asks for PayPal gift.
2) Fraudulent buyer agrees to buy the item
3) Fraudulent buyer sends seller $X using PayPal gift funded through a stolen credit card. Since he's never going to pay for it anyway, what does he care if PP charges him another 3%?
4) Seller ships
5) Fraudulent buyer gets his item.
6) Actual owner of the credit card sees the charge and disputes it which causes a chargeback to PayPal
7) PayPal pulls the payment back from the seller (and if he's withdrawn it, they'll debit his bank account that he sent it to and/or send him to collections). Since it's against their ToS and technically fraud to accept gift payments for goods or services, he doesn't have a whole lot of leg to stand on in fighting back against this situation.

The seller in this case is out his item and has no money to show for it... and his PayPal account is also probably now frozen or closed.

The truth is that using PayPal gift (or "personal payments" as they now call it) is against their terms of service and is intentionally defrauding PayPal of the fees they ask for you to use their service. It's shady and you REALLY shouldn't do it because it's dishonest... not to mention the fraud possibilities for everyone involved.

If you really don't want to give PayPal the money they ask for their services, find another solution to move the money around and keep your integrity.

What I said and what jbregar said "Stay away from PayPal Gift either Buying or Selling"!!!!

I'd also like to add, some of you LONG TERM/ RESPECTED users here on DVXUSER should assist in this area. When you offer your ITEMS FOR SALE for PayPal gift, you're promoting cheating PayPal out of 3% for using the service.

Just charge the 3% and use the PayPal Invoice Service (FOR SELLING ITEMS)! Which is what we're all actually doing. The PayPal invoices service protects the buyer and seller!!!! Hope all works out for you Justin.......hang in there!

Always use your best judgment and read the policies and procedures, related to all payment type services.

We cannot dictate the terms that private parties determine to use in transactions.

However, I personally never use PayPal Gift. It simply does not provide protection to either party, apart from misrepresenting the true transaction with PayPal.

We also recommend PayPal invoicing. Know your buyer or seller, and be diligent in using the money transfer protocol best designed to protect the parties in the sale.

How does the invoice protect better than just sending the payment (for purchased items) directly to the seller? The only thing an invoice allows is for payment from someone that doesn't have a paypal account. But there might be something I don't know about too.

The newest feature that is supposed to help protect the buyer is pay after receipt (this is free), this is where Paypal sends the money to the seller, but won't pull it out of your account for 14 days. In a legal sense, this makes Paypal the first buyer which gives them a stronger case if something goes to court for non-fulfillment.

I've already been in contact with you regarding this issue. I've bought and sold on this forum for far greater transactions than ours, no less than several dozen times, and I'm still trying to resolve ours with the post office. That being said, you yourself have called this forum a joke in your posts, and don't seem to take anything seriously. I'll contact you when I hear back from the USPS, until then please stop cherry picking emails and making these posts; they aren't incentive to want to help out.

I'll contact you when I hear back from the USPS, .

You'll never, ever hear from the US Postal Service. I even have some of their private numbers and stiil have had a couple of packages lost. What does the tracking say? It should give you dates of when the package arrived at certain destinations per their scans. If it stops at a holding center and never says "0ut for Delivery", then the package is lost in a great "Big Hole", or it got stolen. If it says " Out for delivery" and never signed for, it got stolen or placed in the wrong mailbox. They won't help anymore than that. Always use insurance and Delivery Conformation. It cost just a little more and is well worth it. In fact, you can send Any package through the Paypal mailing system, using USPS or UPS. And Delivery Confromation is free for USPS packages. You put in the email of the buyer and he will get all the tracking updates.

Just an update for those who may have interest in my situation..

I am lucky if I get responses from Michael Riley. I send emails once a week with no response. The last email I got was telling me he would setup a visa with his PayPal account and resolve this. I patiently waited over a month. He ignored my last few emails asking for updates. His last response said this:

Hey Michael,

Thank you for your email.

With PayPal, you just have to link your credit card to it. No approval process, pretty straight forward. Got mine setup in 5 minutes. So unless you take your time with it, you should have it set up same day you do it.

Please post me later to let me know status.

Good luck with the move.

I haven't forgotten about this, just in the process of moving. I have had a paypal account for a long time so I can probably get approved for a caard for them. I didn't know they had cards until you mentioned it. A loan from the bank probably won't happen though because I don't have collateral and no job.As far as a hard timeline goes, I don't think its unfair for you to ask, but it depends if I get approved for this card or not I suppose.

Hey Michael,

My apologies for your loss.
Over the past month I have lost my mother in law and am now with my father in Australia as my aunt is in the hospital. I had to take out a loan from the bank to cover our flights.

I know it can be difficult.

If I were in your shoes I would be doing everything in my power to make good and resolve this and assume responsibility so I don't get a bad name or look bad.

Please give me a hard timeline on when you will pay me back. A believe week is more then reasonable. After waiting over 3 months, I don't think it is unreasonable for you to put this on a credit card with PayPal or to take out a loan from a bank in the worst case. I'm sure you're inventive enough to find way if you're a talented filmmaker.

Now I understand that isn't your fault or problem, I'm just giving you the why is that I've been having a hard time. The post office informed me that there is no way to track it. There is no way I can get you your money back this week, but I will figure out a way to repay you in full as soon as I can. My guess is that if the lens hasn't come in for months, and hasn't been returned to me, that it is lost and never showing up.

We have known this is an issue for over 3 months now. You said you paid for express shipping because you sent it later then you planned. Anything taking longer then 5 business days on express is an issue that you as the seller should be expected to resolve.

Why you have left this so long and still haven't closed this, is something I truly do not understand.

I would appreciate my money back if you cannot get me my lens this week. Please let's settle this finally.

As far as you posted in the DVXuser forum as seeing me post about buying more stuff, I'm not sure why you feel that way, as I haven't bought or sold anything since knowing for sure the package was lost.

Until then, understand there isn't anything else I can do. It's not as simple as refunding the money because that isn't an option on my end, I simply don't have $600 laying around. Not that it matters but I'm not working right now, its not like I have a stead income coming in. Again I'll let you know tomorrow at the latest what they say about tracking it down.

Can you contact the post office you shipped it with and have them backtrack the shipment to the day it was apparently shipped. I would imagine they can look it up as per the senders name and possibly the receiver (yourself). At the very least, try contacting your local office and tell them what happened. Some proof from the post office and tracking numbers to show where this ended up would settle this once and for all.

I would like to resolve this so we can both move on.
