I'm back in town! GH13 footage of Prince last night in NYC!

I don't know. I'm looking at all the mumbo jumbo on my ticket and do not see that anywhere, but I do know Prince is a nut case about it - but I did not post any full songs or a full concert, just a snippet, such as would be shown on a news show when they talk about him as they will surely do tonight on the local NYC news - but I'm no lawyer (thank god), so I will take the compliment on the footage and move on. Again this was not done on the sneak.. the camera was around my neck and I was in prime view of security who did not stop me when I had the LCD open and taped some bits, one of them was actually amazed and asked me about the camera in a friendly manner, not to stop me. I won't even talk about what happened when I pulled the dinosaur puppet out.

Well, IANAL but, technically speaking, he purchased a ticket, which is a contract, which I'm pretty sure stated specifically "no video recording devices allowed" among every other variation on that theme. So technically he acquired the video in breach of the contract which would likely outweigh any fair use protection.

But what I want to know is... You wear a costume? Like a superhero?

Man I am so behind the times.

Copyright is not a natural right but an artifiicial one. The government established it for sole purpose of to "promote the progress of science and useful arts" (U.S. Constitution). As an artificial law, and not a natural one, it is more limited. For example, I can't claim "fair use" or "the ends justify the means" if I kill someone, because life is a natural right. But copyright is an artificial right, and it should be given only as much power as needed to "promote the progress of science and the useful arts."

This video is not hampering the progress of science or the useful arts. It is promoting them, specifically the GH13 hack.

Nor is it causing the Artist formerly known as Prince or his record label to lose ticket or record sales.

If he had posted a still photograph instead of a moving one, no one would have said anything.

Hard to manual work it when you are dancing and holding a martini! I wasn't really there to shoot a video I was there to have fun... yet I did get some amazing stuff. Believe it or not this was the kit lens wowing me yet again. Remember also that facebook down rezzes it to 1280 x 720... like vimeo does (unless you pay and use the secret hidden menu.. which I do) there is WAY more detail in the original 1920 x 1080p.. and no compression artifacting.

What is the secret hidden menu?

"Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use."

The problem is that the owner of the content determines whether your recording falls under fair use or not. If Prince tells FB to take it down. They will take it down without question. It will then be up to you to prove it is fair use in a court of law.

As someone with 30+ years of Copyright experience, I can say that you are mistaken in your assumption that this falls under fair use.
By video recording the concert with sound and posting it, you were in violation of the Copyright law forbidding you to make an audio recording of said event in said venue.
I'm not going to get into a pissing match with you kids. Hey the video came out great, but it was wrong for you to do it. Bottom line.

All the Best!

Dave

Does any recording of a concert with sound ever fall under fair use? The problem is that the owner of the content gets to decide what is fair use and what isn't without ever going to court.

@Jackomo
I actually AM a super hero, only topped in power and style by my masters - the Thrice Great Okapi (http://blackout.com) or wikipedia Okapi... I'm in there somewhere I think...

If you are a vimeo + member, after you upload your 1920 x 1080p footage vimeo will stupidly (in my opinion) downsize it to 1280 x 720. After it does this and the first encode is viewable, you can click on the GEAR icon (settings) in the top right corner and then when that page comes
you click on up you click on "Video File (plus) under the basic menu setting bar on the left.

Once you do that you will see the super ultra magical double your quality full resolution 1080p button... click it, and now vimeo will go BACK to your original uploaded master file and re-encode it to 1920 x 1080p which complete kicks ass over the 720p version. But be hush hush about this I don't want anyone on DVX knowing cause then their videos might look as good as mine so shhhhhh we'll keep it secret.

As of yet I have not found any way to set vimeo to ALWAYS do this.. which seems very retarded to me, so you always have to go through this process and basically waste time having vimeo encode your videos twice... but maybe I am missing something.

For an example of how much better 1080p encoding looks check any of my vids out on http://vimeo.com/michaelbiggins

This message will now self destruct.

Hi tophat, just ignore it about copyright. No lawyers here only pretend lawyer. I am lawyer in my home country before I become filmaker and came in usa. Giant company and prince are fascist and anyway you make home video just like all over youtube. Giant entertainment are fascist, in my country dvd cost average person one week salary and then fascist company complain if we pirate. So just ignore fake dvx lawyers here.

I think it falls somewhere amongst shooting in Private or Public places... In public area I can shoot pretty much what I want ... any people, places etc...

In a Private setting I must follow the rules set by the administrators of the Private setting...

I'd imagine that if you bought a ticket it would be in a private place... (although the venue could be still classified a public hall it was probably hired for the gig.. making it private)...

Cheers

The OP admits in his first post to having "smuggled in" a video/film camera. He was aware of the fact that many people have yet to cop to the ability for a form factor to appear one way, while functioning in another.

I have done something similar in a museum and was finally caught when a guard saw me panning my point and shoot. However much I would like to post the clip that includes the footage, I won't. It was done as a proof of concept and was shared only with the actor in the clip.

That doesn't excuse my actions. At the very least I was non-compliant with the explicit wishes of the museum not to video exhibits.

An artist has the right to tell you what you can do and not do regarding the capture of their image and music when they sell you a ticket. Do many people ignore that wish? Of course. Do many of them make money off of the act? Doubtful. But some do, and that is where the problem lies.

Does posting on a semi private forum constitute self promotion? I don't know. It could, especially if producing music videos is what you otherwise do for a living. I don't "do" Facebook so I can't see the clip. My feeling is it was done innocently as a "show and tell" act. And I guest at least one poster thought that it "put one over the man".

Having said all that, this what I now need to do. :bath:

@ghosttv your message cracked me up. Good times.

Anyway... I'm just showing off my good time at the Prince concert and how amazing the camera's footage is even when I was completely not paying much attention to shooting - but just having a blast - plus a lot of my friends are Prince fans, so if anything, this footage is making them WANT to go to the concert when it hits their town more than anything. As far as self promotion goes.. believe me guys I don't get ANY business from posting here on DVX... not a one client, I just like yapping with you peeps.

And as for $ and Prince, I have spent more $$$ on Prince stuff than any other artist so if his little purple a$$ wants to come sue me then I want my money back for the sucky albums I bought! But I kid I kid.... this was a damn good show, and I got to meet him for a sec, but that's another tale for another time.

As far as to the facebook thing - I figured it out. Sometimes http://facebook.com/therealMichaelBiggins won't let you see the video if you're not on facebook because it's my private real friends and acquaintances, but I just put up another little snippit on my whoremonger facebook page: http://facebook.com/blackout and on that one you should be able to see it without joining the communism that is facebook.

I get why some people don't like facebook but it has been absolutely useful to me more than any other site and on there I DO promote myself and on there I DO get lots of clients and fans and contacts, but the Prince vids are not about promoting my camera work. Just like ghost said it's showing the experience I had. I can do much better camera work than that I assure you! Anyway I'm an actor director.. how I got into DPing and sound mixing I'll never understand... wait.. oh yeah.. the guys I originally hired and paid a lot of money sucked... that's how. Don't try this at home! (shooting music videos while holding a martini and a dinosaur puppet and dancing)

The Prince clips are more just to make my personal friends in NYC who didn't go (and who many I invited cause I had an extra ticket) a little jealous... and it worked. :Drogar-Love(DBG):
I see yahoo has already put up clips of Prince booting Kim Kardashian off the stage. They used a little snippit in fair use. I think I have the exact same footage just way clearer and at a better angle! It was a funny magical kick a$$ night that's all I can say.

This video is no longer available due to a copyright claim by NPG Records Ltd.

Yahoo Music said:
...because of Prince's staunch anti-Internet stance, no fresh footage of him has managed to hit the web in years. In 2007, the singer even got into a fight with his fans when he pulled down images of everything from Prince-inspired tattoos to photos of his album covers -- and when his devotees got angry, he wrote a diss track called "PFUnk" that includes the line, "I love all y'all, don't you ever mess with me no more."

Looks good, but I can't understand how your footage is not all grained out. I shot with the GH13 and in low light this little cam did not do well even with the 45 mpbs lpowell patch iwth 1.7 f stop. You must be shooting with a Nokton .95 lens or something since I have never seen dark footage this good ever on a GH1 or GH13

Hahaha..... lpowell it was pulled down and now it's BACK up and on E entertainment news as well... the more he tries to smush roaches.. the more comes... I stand by my original post that artists need to chill out with this stuff - especially in this age, and I AM an artist... no.. I am not making Prince amounts of cash yet, but I will be, all the more reason he shouldn't care. I can tell you for certain I won't be chasing down kids posting holographic youtube 7.0 vids of me. It's ridiculous.

Thanks - I think it actually looks pretty crushed on facebook.. man you gotta see the raw mts files especially the wide I can see every little head and face. The Prince concert, while appearing dark, had tons of lighting...

THIS is the darkest footage I have ever shot:

I think I have a magic GH13 because I agree - I have two other GH13s with the same custom settings and they streak.. ONE - my main one, does not. This was NOT even a fast lens it was the kit lens and my iso was PUMPED like Arnold on roids!
