Filming in public places without permission - when it does and doesn't make sense

In general it seems that its ok to film in most public places without permission, but under what specific circumstance is it NOT a good idea?

Are there any guidelines as to what can, and cannot or should not be filmed without permission?

Does it depend on whether its an interior or exterior location?

Does it depend on the eventual distribution model for your film and-or the budget involved?
 
In general, it depends on the use. For example, for use in commercials, it is MUCH more restrictive. Everyone and everything must be released. This is because, for commercials, the use falls under "implied endorsement". This means that anyone in your commercial can claim that you are insinuating that they are endorsing your product.
 
One thing for instance, I had to film in an outdoor shopping mall. I knew they had security on duty, so a couple days before hand I checked with their security office and told them what we were going to do and that I would do my best not to get any stores or branding in frame. They were ok with that. Course we had a couple cameras, lights, and mic so it was obvious. At another shoot, there was this city monument, I checked with a couple of businesses that were located right there, they gave me a number to contact. I never called them, we just unloaded the cams real quick, filmed it, got my b roll shots… there were a lot of people, police, busses.. etc cruising thru, and nobody bothered us.

All that to say every situation is different. But yeah it all depends on what you are using it for too.
 
The best thing to do is to check with your local film commission, if there is one, or to check with the city on filming permits. They'll tell you what restrictions there may be, and what permits you may need. Many cities and towns don't even charge for most filming permits (assuming you don't need to shut down or re-route traffic, or require on-site security), especially for crews of few people (1-3) that aren't going to be disrupting anything. At that point, it's really only about having the permission documented in case the police happen by and decide to check credentials.

My city will charge you a really big permit fee and also require a million dollars worth of insurance, even if you're just doing a student film.

You're better off doing it guerrilla style than going through the proper channels if you don't have a commercial or Hollywood budget, but everywhere is different.

My city is entirely different, and only has a fee and insurance requirement for certain types of productions. A sweeping recommendation based on an individual experience discounts too much. This is why it's best, as I said, to research your own city/town before you proceed.
 
Saying "you're better off" is a statement I'd take exception to. Saying "you might find it easier to get away with doing it guerilla style" might work, but the other side of that is that if you don't get away with it, you almost certainly won't be better off! If there's an accident, or if you're arrested, or whatever else might happen, you're certainly not better off.

As for things that will get you stopped -- pretty much if you put a tripod down, you're going to attract the attention of the security or nearby law enforcement personnel who are going to ask if you have permission. If you're using commercial-looking equipment, lights, mics, dolly, stabilizer etc., or doing anything involving weapons or confrontation, you're likely going to get stopped. And if you're doing anything at all suspicious in or around public property within a week or two of a terrorist attack such as what just happened in Boston, you can bet the heightened awareness of the officers are going to lead to you being stopped, questioned, or more.

So -- if what you're doing is going to look as innocuous as any tourist taking photos, you may choose to risk it. But if you're doing something on public property, where by law it is required that you get permission, why not just ask for permission? No matter what other factors play into it, you're better off if you have a permit than you are if you don't have one.

Most definitely.

And some jurisdictions have lighter requirements for smaller crews. When filming on the Las Vegas Strip years ago, the film office told me if my crew was 4 or smaller, and we didn't put a tripod on the ground, that the requirements were much more lax than if we showed up with a big crew. So definitely go ask your local film commissioner.
 
I would also recommend thinking long and hard about stealing shots on private property or restricted property and any brand if you are ever planning on selling your work or doing it for a company. In this day and age of easy money through lawsuits many people can and will come after you down the road for compensation or pull your production.

As a Television producer I have to be very very detailed and get everything on signed waivers, releases and consent forms. Word of mouth permission is worthless.

It is not a good idea, when there are laws and ordinances in place against it... or when it could cause a potential hazard, which could open you up to civil liability (such as putting down a tripod in the middle of a very busy pedestrian walkway).

Most definitely. And you'll find them at your local film commissioner's office. Every state, and every municipality within that state, can have different rules. Some are very free and easy (in North Carolina, what you did on your own property was your own business. In California, they can require a film permit even if you're filming in your own house, and I've been told they require someone with a pyrotechnics license to be present even if all you're doing is lighting a candle!)

The only answers that matter to the questions you're asking, are the answers that are relevant to the municipality that you're shooting in. And those answers can be gotten from the local film commissioner.

Perhaps, and it further matters whether it's public or private property (a mall may be perceived as a public place, but it is private property; in that case, you may need permission from your film commission and permission from the property owner). And furthermore, even if you have permission to set up your crew, you may not have permission to film certain properties. As an example, the World Trade Center (which no longer exists) was a copyrighted design, and you couldn't reproduce it in film without permission from the property owners; same thing with the "Hollywood" sign.

No, and yes. The question of whether it's legal or you need permission absolutely does not vary depending on your budget or distribution; if permission is required, permission is required, no matter what. But what does change is -- will anyone care? If you "steal" a shot of the Hollywood sign, and put it in a wedding video for Ron & Kathy, and only they and their parents ever see it, then ... nobody cares. But if you steal a shot of something that requires permission or licensing, and distribute it big, then yes, you can expect that someone might care in that situation.

As far as during the shoot day, the cops will not care what your budget is, or that you're "students" or whatever -- if they see you filming something that they think requires permission, they will ask for your permit. If you don't have one, you will be shut down (at the least). Depending on where you were filming and how you're acting, they may decide that further actions are necessary.

Step one in any discussion about this should be to head to your local film commissioner and ask them your specific questions. Chances are they've dealt with the situation before and will know exactly what to tell you. And the only answers that matter are local answers. How they do it in New York has absolutely no relationship to how they do it in Texas, etc.

In my city you either have a million dollars insurance, or you don't get a permit. Period. My point is if you don't have the money for the insurance your choices are guerrilla style, or don't shoot. This is directly from the permit and there is no small crew waiver, student waiver, etc.

The permit fee itself is 200 dollars a day. There is no reduced fee for student films, small crews, etc. I've checked with the Film Commission. You pay, or you shoot somewhere else, or shoot guerrilla. With a DSLR you blend right in with the tourists.

INSURANCE: Please attach a copy of your proof of insurance (minimum $1 million in coverage)
Prior to session, insurance certificate must name (City name here) as an additional insured.

That's your city. That's not all cities. And even if your local municipality does require insurance (as I'm sure most do), it isn't that expensive or prohibitive. If you're a hobbyist, it may be a problem; if you're in the business, it should be an incidental cost. But regardless, the other points all stand, and the only way to know what really applies is to contact your LOCAL film commissioner and get the rundown on local rules. Some may be cooperative, some may be prohibitive, but the only way to know is to ask locally.

You are correct. Each city is different. For Hollywood productions or a Toyota commercial a million dollars insurance and 200 a day film permits are peanuts, not even a major consideration.

A million dollar liability policy for a short duration shoot is around 1,000 bucks or so.

If you have your own gear, you really should have it insured... especially if you make a living from it. Renter's insurance won't touch it, and homeowner's insurance isn't enough. Really, a small business insurance package is the best way to go (though, talk to your insurance agent for the best options they have available), and should include a liability coverage as well.

$1000 for a short-term project may be cost-prohibitive for the freelancer/independent producer, but $1000 over a year takes the monthly operating cost down to a manageable level.
 
This discussion has interestingly split into what is required to shoot something and what is required to exhibit something. Shooting involves liability. Exhibiting involves licensing the image. Liability, as noted, never changes. Licensing requirements can easily vary. For example, here is L.A., Disney tried to stop someone from showing their film because their music hall in downtown L.A. was in the shot. It is my understanding that it actually went to court and the resolution was that, since the scene was shot from a public perspective and wasn't meant to feature the music hall, Disney was told, basically, to stop being jerks about it. If they are going to build their Music hall in Downtown L.A., then it's going to be part of the public domain background (disclaimer: not a lawyer). However, as I noted earlier, that does NOT apply to commercials. It also does not apply if the building is the main subject in the shot.
 
I guess, the question to ask is: What is this shoot worth to you? Is it worth the potential of gear confiscation? Is it worth arrests/fines?

In some areas, you can get away with guerrilla shoots, others you can't. Trying to assume that you can get away with it without knowing what your regions response/laws/regs are......is foolish and irresponsible. Especially if it is someone else's gear you are using.

I'm pretty sure that here in So. Cal. communities have a heightened sensibility about 'film shooting'. I've looked at most of the counties that I would think about shooting, San Diego, Riverside, San Bernardino, Imperial, Kern and Inyo... all have some form of 'film permit' requirement. The state also has similar requirements. If the permit is 'free' there is the insurance rider required in most cases...

Since I don't have a 'business' at the moment, I don't know if I could get a 'rider' via my home owners... and of course paying a grand or two for 'insurance'... well the Wife would not permit that..., so for the moment if I shoot in a 'public place', it's going to be very minimal, and guerrilla style... as it is, I've not had the occasion to shoot on public property for narrative film making, but use to for the Wife's wedding biz. There was an attempt by the San Diego City Council to require permits and fees for wedding photographers/videographers but there was sufficient grass roots crowding into the council chambers that they 'tabled' the idea 'for now'... that was several years ago, so I don't know if that has changed, as we are out of the wedding biz...

To me there is no difference between a small (sort of... we've had 50 or so 'family members and friends' in some of the wedding shoots...) wedding party shoot and a 'small narrative film' shoot, in fact, unless there some major 'action' scenes, the narrative shoot may be less intrusive than the wedding party shoot...

But that seems to be the way it is...

I worry about shooting in Mexico... which I've done 'without' permits for several weddings... but only shot on the grounds of the facility where the wedding was held...


Here's a brief story in case you write off Herzog as being crazy. On The Social Network, the authorities didn't allow the filmmakers to shoot in Harvard Square. Well, the filmmakers wanted to. They covered a pretend street performer in lightbulbs and put him underneath some archway in order to light up the scene and create a distraction. Then they shot with long lenses the scene that took place next to it. This was on The Social Network, might I remind you. Filmmakers with purpose don't let their lives drift by following stupid rules.

There is a similar story about Hitchcock shooting the UN Building in "North by Northwest"(1959), using a vehicle across the street and having Grant exit a taxi in front of the building...

But I don't think that was his typical mode of operation...

David, if anything I said was antagonistic or argumentative, please keep it removed. But the rest of my post was full of good information that I believe would be a disservice to keep down. I hope I can keep posting my thoughts to this forum. I truly intend to be helpful and nothing else.
