Hi everyone,
I have been here for about 6 years and have had over few dozen of amazing transactions and people but in the last month I have been dealing with a new user Gemster who I would say stay away from.

I purchased a battery from him few weeks ago and he promised delivery by August 14th. He said it's been shipped on August 10th and I will have it by 14th. When it didn't come in and I mentioned to him that I need it for a shoot coming up on 15th, he messaged saying sorry I will ship it on Monday. And since then no response. I have opened a dispute on paypal. I will still give him benefit of the doubt but regardless a simple message giving me tracking # would have been nice.

My suggestion, stay away from this user

I already told you about the situation. PayPal has the funds on hold and I can't refund you. They only have the privilege to do that on my PayPal account . Call PayPal and tell them to refund you. I am sorry about the hassle but PayPal told me not to ship so I went to pick the item back up. I would not blame you but your post is unnecessary. Some feedback about are transaction would have been more appropriate.

Gemster,

Paypal hold the fund since the buyer file a claim. As long as you provide the tracking info that you already ship out then the buyer will cancel the claim. YOu're the one that don't ship out the item as promised. His post is necessary for all other member to be aware of this and not to deal with you in the future.

Please let me know when did you tell me your situation. I have no messages like such and I communicated way more than I needed to and your assurances that it has been shipped not once but twice without a tracking # led me to open a case.

On August 11th (Monday), you said it will be there 14th (Thursday)

On August 15 (Saturday), you said it will be there by August 17th (Monday)

Since I didn't receive any messages despite me sending you messages, I opened the paypal dispute on August 20th.

And since I ordered the battery for a specific shoot which I mentioned to you, I have no desire for this item since it wasn't only failed to deliver on time but failed to deliver period

My goal with this post is not to get something that I wanted by August 14th anymore as the shoot date is past and I had to make other arrangements but to make everyone else aware.

When you sent the funds the payment was being reviewed by PayPal and PayPal told me not to ship out yet. I shipped out anyway but then called PayPal so they told me that I should pick the item back up because the funds can be reversed back to the buyer. A week in a half later the funds are released to me and a day after you make a claim.

Why make a post about me? You could have gave me some feedback for other buyers to see. I am sorry for the hassle and understand why you are upset. I would call PayPal right away to see if they can reverse the funds back to your PayPal account. But 9/10 they are going to say "Have the buyer call PayPal".

Really? Do you have proof of that? Because I don't. And hypothetically if I was to believe you, did you tell me once that in the messages. All I received was, It has been shipped twice without tracking # and I have provided the proof above.

My goal is not to attack you in anyway but I am a member of this community for 6 years and so are so many other people. You seem to be new based on your posts. We deal with each other based on trust. We inform each other if things happen because they do. And that's the problem with this transaction. Misinformation at multiple times and my post was to prevent other people from future intentional and unintentional transactions with yourself. It is necessary. I even warned you that I will open paypal dispute and post publicly last week. I didn't get a response to that either.

I opened a case so the ball is in your court to refund

I am not about to go back and forth with you Jawad. I told you about the situation already and you said that you understand. I am about to call again so will keep you posted.

What is your situation. When and how did you tell me. And where and how did I tell you I understand please do enlighten me. Don't try to hide your fault by saying you said something that you didn't. If you have PROVE IT!!!. The fact is that you never shipped even once.

Like I said I love this community and like others I don't want someone who doesn't do what they say and then make up stories to ruin it

Yep, sounds like a con to me. And from SC. ALL of my bad ebay and Amazon transactions are from that area. If you sent money over state lines, then it becomes a federal offense.

Did you ever get a tracking number? When someone goes to USPS, FedEX,etc., you'll get a tracking number at the counter. And how did he go back and pickup from the carrier? There would Still be a tracking slip.

JohnnyD,
I didn't receive any tracking # and I received only two messages from the seller spaced between 5 days that it has been shipped twice. Like I said things happen in life, we all go through things and only if the seller had truthfully explained the situation (this would have been dealt with) and yes exactly, how can you go back and pick up the item once you shipped it.

In Gemster's defense, I recently sold a lens to a user here on the forums and the funds from his payment were similarly put on hold and PayPal instructed me to not ship the item until the funds had completed the review process. However, it did not take a week and a half in my situation. I think it was either a day or 2-3 days if I remember correctly.

Point being, he could be telling the the truth about all this.

That's not to say that there was good communication from Gemster as a seller in this situation. I would just tread carefully before some of you guys blindly say he's a "con". So maybe he had some bad communication. But I don't think he's a "con".

SO whats required to resolve this situation from here?

Jawad, unfortunately you can't be reimbursed for the inconvenience from this. Have you been refunded? And if you were would that resolve the matter at hand?

Cheers.

I had a horrible issue with him as well. Look at his website full of photography.. then look at the photo of him holding like a Canon rebel with kit lens….

This guy is a fraud, he tried to sell me a c100 and told me he would ship it in the morning, day goes by and I heard nothing so I did open a case with paypal and was thankfully refunded 24 hours later. If he owns anything, he should take photos and defend himself. Other than that, everything about this person is pointing to fraud.

Cory the C100 is my first camera and I own it. What are you trying to say? That I can't shoot amazing images while owning a rebel? That does not make sense at all. I refunded you ASAP once you wanted a refunded. You never gave me anytime to ship out instead you made a claim a few hours after you sent payment and I refunded you as soon as you made the claim.

But Jawad PayPal told me the same thing. Call them now please.

I have no beef with any member, but similar things have happened to me before, and for some reason Paypal do not have cleared funds and advise the seller NOT to ship. From time to time it seems that blips happen. I got a paypal cheque once - no idea what this was, but Paypal told me the funds would take time to clear and it took about 5 days before I got the money. It does appear that the buyer does the transaction as usual and then something goes wrong that neither party intend.

As an ebay seller lots of things go wrong, but it's very easy for ebay to side with the buyer, so recharges happen when you don't expect, buyers can return items from business sellers and it's stacked against the person selling. Sometimes you have to really check everything - making sure the ebay notification and the paypal notification both have the same address. If you send to the ebay address, rather than the paypal address it can result in hassle.

In the case here, somebody bought something and paid for it. Unfortunately, the seller didn't get the money. I can see how the buyer is cross about not getting the goods, but if the seller didn't get the money, then why on earth would he send the goods and not get paid?

Both sides have a complaint against ebay and paypal.

However - it's pretty clear communications broke down between the two parties. There seems little point in both parties bashing it out here. There are two sides to this one, and we don't have the evidence (or the inclination) to be Judge Judy.

OT

UK TV have shamelessly stolen the Judge Judy format, and we now have Judge Rinder.

Gemster,

Post a video ( with camera or phone ) of you with the used Canon C100 with auto focus upgrade and say my name. Your face/ mounth saying my name, camera all in frame.. Post this within 5 days and I will rethink my opinion.

Cory I take that as compliment that you think my photos are stolen. Why are you still in this dispute? It's between me and the other buyer. I refunded you and you have your funds so why are you still wanting me to confirm that I have the C100 in my possession? I refunded you the same day you sent payment and the same day you made the claim and now you are calling me a fraud?

You also keep saying that I am holding a rebel and a kit lens. Why do you hate Canon Rebels so much? I own a C100, 6D and T4i. Please just stop throwing jabs at me man and let me resolve the issue with Jawad, thanks.

He just joined dvxuser. This is his website http://www.baileysimsphotographysc.portfoliobox.me/ this is his about me page http://www.baileysimsphotographysc.portfoliobox.me/about-me ... What is shown on his page are beautiful photos (probably stolen from the web somewhere) and he is holding a Canon t2 rebel camera with kit lens in his photo.

This is the second complaint about him getting gear out the door. He is wasting peoples time and is a fraud.

Come on guys, this is childish. Let me state this " THINGS ON THE INTERNET LAST FOREVER!!" Unless you have 100% proof this guys a fraud, you can't go around using slander, and defimation of character. As Paul stated, Stuff happens. Lets give people the benefit of the doubt. Everyone's so quick to jump to conclusions, and yes, I've been guilty of it as well. But we learn as we go.

The whole take a picture and say his name bit is a tad childish. At this point he has nothing to prove to you. And your entitled to your opinion. I don't see any reason to slam him based on the communications here.

I think what I stated are wise points to look for with a fraud, as well as he described a C300 and not a C100 in his message to me. The c100 has a monitor that is connected to the body, its not a lcd module.

I dusted this off as mistake as he mentioned he was selling a C300, but anyone really confuse a c100 with a c300 when selling? I am not posting on this becasue I have any hurt feeling from this, whats in the past is in the past. This has happened to me as it did to the author of this post, so I am more than qualified to post with my suspisions, especially when it all adds up.

My input is to help others on dvxuser who are purchasing gear on this messageboard.

"A smart person solves a problem, a wise person avoids them" So why would anyone get involved with this, if you're not dealing with paying for gear and not receiving, as well as him lieing about sending out gear?

Of course Gemster may have a point but he has the choice of proving me wrong with what I asked. Upload a video of you with the gear you say you have (He mentioned in an message he ALSO owned a C300, but didn't in this post). And like I said, this doesn't involve me anymore, it's in the past and I don't believe this person. But to be involved in a community of filmmakers, I think it is a wise choice to prove to everyone you are who you say you are, with the gear you have and prove me wrong.
