Did I get a pre-used 7D?

So I got my 7D in the mail today from B&H Photo.

I noticed that the box was not Shrink-wrapped (usually anything from the store is shrink wrapped). Also, the plastic packaging holding the documentation was not sealed and looked like it might have been opened.

Did B&H send me a camera that had been pre-used and/or returned?

Is it legal for them to sell a returned camera as new without disclosure?

I guess it's fine as long as it works, but still kind of a bummer to pay all that cash and not get something out of the box.
 
My 7D box was not shrink wrapped - and I bought it locally the day they received it, so I know no one had used it.

On the other hand - the documentation (the manual at least) was sealed in a plastic bag.
 
do photos get numbered sequentially?
If the previous owner took stills..your 1st photo would not be 001.
I think thats right.
 
...i got my 7d in the first preorder batch to ship from adorama, the label for my first photo was somewhere in the 7000s...i'm hoping thats not the shutter count...cuz that would be strange...
