i was in a car accident

Glad to hear you and your family are OK. As for suing the guy, yeah, go all out, but realistically if he's driving around with no insurance on expired tags odds are he's not going to have enough assets to worth bothering with... it also indicates the kind of a guy who doesn't have it together - what are the odds he's got a thriving career? I bet he's a loser. Most important - you all are healthy.

Glad to hear you and yours are okay, Uga. Generally, your insurance company will take care of suing the guy.

It pisses me off when things like this happen. I'm glad your family is safe. I'm on the road all day with my company, and for someone like me it is more likely that something like this can happen. I take my driving priviledge very seriously. To know that some idiot can just jump behind the wheel of a car with out a license, nor insurance and indanger the well being of others who truely rely on this priviledge for survival sucks.

Hope everything works out for you man.

I'm glad that you and your family are doing well.

I had a similar accident a few years back one beautiful Sunday afternoon. I went through an intersection (green light) and was broadsided on the drivers side by a car going through a red at high speed. I didn't see her coming until the last second due to the large line of cars turning left. She ended up removing the front of my car and continued to careen off into a ditch down the road. We did a 360 with a double twist and ended up against a lamp post.

The car was a complete right-off.

LUCKILY!! My 1 year old daughter's car seat was very effective. I hurt my arm as it slammed against the side of the car. My dog was in the back of the wagon (we had a gate up separating him from the rest of the car), he was a little banged up and bloody, but none the worse for wear.

Partially in shock, I got out of what was left of my car even though my door was difficult to open. I removed my screaming daughter and waited for paramedics. Probably shouldn't have taken her out but she was fine nonetheless.

There were plenty of witnesses on the scene.
The lady who hit us was 80 years old and late for Church.

The emergency response crew said that if she had T-boned us there probably would have been a fatality.

I feel really lucky now when I look back.

Once again, I'm glad that everyone is doing well.

Take care,

Mike

Glad to hear that you all came out of it okay.

I imagine that you could see to it that this guy will never earn so much as a dollar working a minimum-wage job, that you don't get a taste of, until he's reimbursed your expenses...but I doubt that the effort required to make it stick will be worth your while.

I think people like this do other crimes besides driving around illegally. He'll most likely go to jail on another charge.

I trust the baby is doing alright?
I'm certain that you're all shaken up - but thank god you and your wife were able to walk away unharmed.

I hope it all works out okay for you.

Ditto.
EDITED TO ADD:
I'm pretty certain it all depends on the specifics of your company/policy.
My wife was once hit by an uninsured motorist - her car was totalled.
It was all covered by her insurance, and her insurance company then sued the uninsured driver.
I have no idea if they ever got any money out of him or not.

Judging from what you have told us, it sounds like you have a similar situation. The accident was his fault, and you have substantial coverage. Whatever your company pays out to you, they will most likely end up suing him for it.

It's subrogation. Since no insurance company likes paying, they are going to claim this guy wrongfully caused an accident when he shouldn't even have been driving, putting them in the position of losing money, so they want it back...from him.

In this case, I agree with them.

i got the police report today. the other guy told police that he never saw me because he had his head turned to the lane he was trying to merge into. when he looked back there wasn't any time for him to stop. there weren't any skid marks on the road so he must not have seen me until impact. the insurance company still has to determine who was at fault, which shouldn't be that hard once they read the police report and look at the damage to the cars.

unfortunately, i get the impression that this guy doesn't have any money to pay for anything.

Man, that is incredibly maddening. For your sake, I hope this isn't the case. But this just sickens me. A buddy of mine was rear-ended here in Cali by a motorist who not only had no insurance he wasn't a U.S. citizen, could hardly speak English and was here illegally. What did the officer do at the scene of the accident to punish the guy? He let him go. His words, "can't get blood from a stone". So, what, you get rewarded for breaking the law and having no insurance? Unbelievable.

Having said that, great news you and the fam are all okay. Thats the most important thing for sure. Take care and keep us posted.

That sucks but glad everyone is ok. Its going to be a long unsatisfying road to nothing probably if nothing was legit on his end. If hes going to take the chance to drive like that, then he will probably just duck and hide the rest of the time they try to sue.
