Rust

I'd want Anthony Hopkins to play the ever-present, dim-witted, hanger-on that filled a forum full of useless posts that somehow had one of his posts quoted in the courtroom to establish key circumstantial evidence

I know from being told first-hand (i.e. crewmember on the show) about an email chain that involved discussion about gun safety issues on set, and producers' responses to it. I can't go into the details, but let's just say it is shocking. I too am baffled that the producers (the actual ones involved in hiring decisions and running the day-to-day) have managed to escape being held accountable. They are doing everything they can to deflect blame, of course.

It will be sad if the producers manage to escape accountability. I don't think it would help the armorer's case to blame them for gun safety issues on set, however, as she'd essentially be saying that they knew she was a train wreck and if they had been more responsible they would have fired her.

You point out exactly what is puzzling me. Why is Alec Baldwin charged as a producer and the other producers are not? This really doesn't pass the smell test at all. Something seems rotten in New Mexico. This is a new DA coming from the side of being a defense attorney. Is this her 15 minutes of fame? Charging the other producers and not Alec Baldwin doesn't get media attention.

I was thinking about this and my guess is that the DA doesn't want to appear to be showing Baldwin favoritism on account of his celebrity. After all, she's an elected official so she has to concern herself with public opinion.

I'd vote for Lori Loughlin.

You're obsessed! She must have really hurt you when she bribed USC to let her daughters in.

BTW, concerning Weinstein -- I agree that people would keep working with him if they could. After all, his misconduct was an open secret for years before his ouster. But few miscreants are so bad that they inspire a global reform movement. His career is over. He'll never work in Hollywood again.

Statement of Probable Cause -- Baldwin Redacted - DocumentCloud

Copying off another site ---

“When reviewing the script and witness interviews, for this particular scene and close-up shot, evidence indicates the scene/shot did not require the weapon to be fired. It was also determined by consultation with expert armorers that in a rehearsal, a plastic gun or replica gun should be used as no firing of blanks is required.”

Baldwin was “not present for required firearms training prior to the commencement of filming.” ... Baldwin

... was “distracted and talking on his cell phone to his family during the training,The photos and videos clearly show Baldwin, multiple times, with his finger inside of the trigger guard and on the trigger, while manipulating the hammer and while drawing, pointing, and holstering the revolver.”

Well, the prosecution would poll and excuse panelist JAMedia from the jury pool. :) You're not helping the 15 minutes of fame at all.

It will be the battle of wills convincing the the jury one way or the other over this sentence from the New Mexico statutes - Section 30-2-3 ".... the commission of a lawful act which might produce death in an unlawful manner or without due caution and circumspection."

DLD's quote provides evidence for the prosecution. A dim-witted person like me could be swayed either way.

 How will I be famous now?
Jury selection inthe US is ammusing as it does not happen like that inthe UK. You get the jury you are given. There are ocasional chalenges but you have to have a good cause to do so. So they are rare.

Yes, It will be fun to watch, Like the OJ trial..... Order in the popcorn and a crate of Bud :-)

As you say a good advocate could swing it in any direction,
12 angry men
A Few Good Men
The Caine Mutiny
Runaway Jury
OJ Simpson

It's going to be the trial od the decade
(unless Trump ends up in court which will be even more interesting to watch)

Jury selection can be a trial in itself for jury panelists. I was on a panel for a kidnap/murder of a 12 year old that got national attention. It was a panel of 650 potential jurors. Ridiculous. We filled out a questionnaire that went on for pages and pages. Even after the judge ruled that the panel could not provide a fair trial and the trial was going to be moved to another county, I was still brought into court by myself with only the judge, defense, and prosecution in the room. I was questioned as to my views about the trial and the defendant. It was one of those moments in my life that was a bit surreal. There I was alone in the jury box with the defendant, an imposing man, sitting a few feet away from me. I testified that my co-workers encouraged me to 'hang-'em-high' and 'kill him'. I wondered if he was going to jump up and come after me. https://en.wikipedia.org/wiki/Richard_Allen_Davis

This certainly doesn't happen in the UK. The Court officals select the jury randomly from the pool and that is it. Defence and Prosecution get the jury they are givem. No questions asked of the jurours. However should the Judge, Defence or Prosecution have a serious problem with a jourour they can apply for them to be swapped. This very rarely ever happens..

For me this is all rather academic. There should not have been any live rounds at that location at all.

It's not academic because presumably some of these safety precautions concerning gun handling by the actor are backup measures in case the gun is faulty or has been misloaded. If they have evidence that he was absent or inattentive during safety training, then his case looks weaker.

It doesn't excuse the failures by the armorer. It would just add Baldwin's culpability to her own. In my opinion, the accusation of mishandling the gun is more likely to stick than failure to check that it was unloaded, since the former is definitely his responsibility and the latter is possibly not.

I only skimmed through the legal analysis that Peter posted, but one of the things they mentioned was that people are judged on a sliding scale. In other words, if you have a lot of experience, they hold you to a higher standard of conduct. If you're a child actor mishandling a gun on your first set, it's one thing. If you're a veteran star who's been handling prop guns for decades, it's another.

if they have evidence of what DLD posted, then Baldwin’s case looks much weaker. If it's all hearsay, then with a good lawyer he'll probably be fine is my guess.

The AD is going to testify against both. That's who probably provided the BTS footage to the DA

The armorer will likely claim that she was merely an employee that was "just following orders".

And Baldwin is the head guy anyway and he won't be able to testify on own behalf due to that ABC interview. And others will try to pin everything on him.

I can't see that working, It hans't since Nurenburg in 1946
It still won't excuse the armourer having live rounds at the location. Certainly not in the way they appear to have been.

I thought there were several producers and Baldwin wasn't running the day to day on set stuff?

And the most important question who will play Baldwin in the film about the shooting?
(assuming he is found guilty and locked up so can't play himself)

the armorer handed them a loaded gun for the rehearsal. That's a no-no. So, either someone told her it wasn't a rehearsal or they told her it was a rehearsal and she screwed it up.

I suppose that they could have told her they were going to do a rehearsal and segue right into filming to save time. But given that the gun wasn't supposed to be fired, she still probably didn't have a reason to load the gun.

And anyway it's her job to say no to unsafe requests
