MUSIC licensing, getting sued.

morality aside, unless your video BLOWS up, I really doubt your going to get any attention from suits, and hey, you might even turn a few people onto a new band/song...

you'll be fine, don't worry about it. There not going to sue you if your not making any money, they might come at you with a cease and desist order, thats it.

I checked your posts and almost every one of them advocate thievery. Is that what you are all about?

I think they may be ale to remove itfrom youtube if someone reports it. It IS copyright violation. I have to pay for music all the time. Can be a drag if it's a big artist, the price they ask is crazy, even for low budget shorts. The best thing is to use people you know who write music or royalty free stuff.

You're right it is like stealing. But if I were to be doing it (which i'm not) it should be flattering to the artist that made the song. By putting it in my film it shows I appreciate there work. Film is not the right word for this, it's more like a stupid skit. Now if I was doing a real short or a film and used there music that would be different.

By the way the track I was talking about is, Edward Shurmeur's Grand Central Station - K-pax soundtrack.

NO- like stealing, it would really be stealing if I wanted to make profit out of it. It's like those people on you tube who try to re enact those SNL skits they're doing it out of love for the skit not out of thievery or any diabolocal skeem to get rich; it's like an omage

Stealing is stealing, regardless of profit. Why is this so hard for people to understand? Do you really think that, if you went into your local music store and tried to just walk out with a copy of this music on CD, that they'd let you because you weren't going to sell it to somebody but just keep it for your own, "non-profit," use? For that matter, since you're planning on putting the final product on YouTube, have you not seen any of the 500 news stories in the last year about Hollywood studios getting pissed about people putting clips of their shows and movies on YouTube? None of those people made any profit from uploading last night's "Daily Show" or whatever, and the conventional wisdom of the average Internet user seems to be that "they should let us because it promotes their product," but the studio's line is, "we own it, so we should be able to control where it's shown"--and they're willing to sue to enforce that. Whether you agree with it or not, under current copyright law, it's stealing.

And your analogy with re-enactments of SNL skits is flawed because you're not re-enacting anything. You're taking the original product and using it. Hell, for all you now, the people doing those re-enactments could be getting sued by NBC right now--just because it's on YouTube sure don't mean it's legal...

its not like stealing at all - it IS stealing. its also a gross violation of copyright law. I dont care if you buy the cd, or stole it off the internet and I dont care what its use is or how much money it makes. you have reused the track without consent and thats stealing. now will you get caught? doubt it. wanna find out? I dont :)

I'd be rather flattered if you stole anything I made and I would be sure to tell you that in court.

Once and for all, profit has little to do with whether you have infringed on someone copyright and there are statutory damages available for this specific reason especially when it is willful.

so what do you guys think about people on these boards who:
go out and test their brand new camera or 35mm adapter, use an audio track featuring their favorite band or artist, and then post their short movie on these boards...

I can't remember anyone ever getting mad at them and accusing them of stealing...if anything, a few people will comment with "hey i really like the choice of music", or "who sings this?"

This is an interesting question. An argument could be made, and I am not necessarily making it, that since the nature of this site is educational (and the videos are for feedback), the test videos in the screengrabs section falls under fair use. Much of this area of the law is fluid, particularly with new technologies. hard to say.

use the song if you want, just dont upload it to the internet or show ANYONE and you will be fine. haha.

Its fine with me if they do it - just dont tell me it isnt stealing or ask me if it is then argue that it isnt. The educational thing is a possible arguement but I'm no copyright lawyer, nor do I want to be.

I agree, if you want to use a song for a test video, just make sure to not post this on the Internet.

Part of the problem understanding copy right laws is because it doesn't seem a very personal matter, usually we are talking about artists who sell millions of songs, not your typical garage band.

But if someone took your video clip, used parts of this for his or her own video, then posted it on You Tube as their own work, it would be a same issue as using someone else's audio.

I also am guilty of using non-licensed music for my You Tube videos, which I made for friends. For my more serious stuff I'll be staying legal.

Making your own soundtrack can be real fun too. It makes you more resourceful, it can possibly fit better than anything else because you created it for it, and you get better and better at it. Sometimes when I need some good soundtrack, I just bust out my ukulele.

They're scared to take a chance in life, and they are basically like the nerdy cop in an action flick who does everything by the book.

Perhaps the real situation is that most of us are more talented and creative than some and do NOT have to resort to thievery of other peoples hard work to make our work better. You can get FREE royalty free music, you can get paid royalty free music and you can get someone to create new music for you, sometimes for FREE.

"Borrowing" music is not your only activity. I'm out of this convo now. Gotta create.

Yeah I look at copyrighted music as a crutch - free yourself and let your work speak for itself - not someone elses work.
