Music Copyright

If I were a major recording artist and you used my music in your demo reel I wouldn't give a hoot. It's not like you're stealing money from my jar. I'd be a little pissed if you didn't credit me. In the long run i'd have everything to gain if people watched your reel and decided my music was the cats ass the rushed out and bought a copy of my cd. Seems to me there are a lot of independent film makers who need music and a lot of new recording artists who need exposure, What we need is a better way for the two to use each others resources for free as they both stand to gain from the deal. Just my 2c

Exactly, in your example, the crediting is key. What would really piss you off is if people liked your music, but never knew it was yours, and associated it with someone else....

Mmm. This one's gonna fit right in.

Now I'm off to re-edit that damn 'Kid Riding Bike' video I posted before Polygram sues me.

I am in the process of shooting a video right now, and I am learning the ropes of getting legit use of music. In the past, I have seen sooo many videos using big name artists in their video that I am 90% sure they didn't have the rights to. I haven't heard of anyone getting sued, but I decided to do it the right way this time. Yea, it can be a pain in the ass, and yea it can cost some $$, but in the end I will be waaaay more comfortable screening my video in a public venue and giving copies to friends and companies for future sponsorship. I have found too, that finding Indie bands is a great way to get music. For me, what I am doing at this point isn't going to make me big money, if any money at all, and alot of indie bands can relate to that. It's sort of a mutual benfit. They get exposure, and I get sweet music to edit to. When I am approaching a band or artist to ask about using their stuff, I tell them that I have little to no budget for licensing their music, but that I respect their rights to their creation and will do everything I can to work something out with them. If I am doing something that I know will only be seen by friends and family though, I just use whatever.....

As a sad side-note, I just heard a report about how people are trying to salvage PBS's great and beloved "Eye on the Prize" series. Apparently, it's been illegal to broadcast it since 1993, since they couldn't afford to pay for rights to compositions (including such things as "Happy Birthday to You") and recordings in perpetuity. They're trying to raise some hefty grants to pay rights and air it again, though they think they'll never afford home-video rights.

It is indeed a tough issue....

I was referring to Mino..........

do people understand music copyright law?

I don't think 99% of the people who use ANY copyrighted material (music or otherwise) understand that they're breaking the law, or they DO understand, and think they can get away with it. These laws are created for a reason, and shouldn't be taken lightly.

Putting myself in that skin; I'd be pissed if I found out my copyrighted material was being used without someone asking me for it first, and at least giving me the choice whether or not I want to be represented in that fashion... Especially if I've been portrayed as something I'm not, or the material was used for something I'm against, don't agree with, or taken completely out of context.

Don't let your reasoning for breaking the law be "I'm not doing anything wrong" or "it won't hurt them" because those copyright laws are designed to benefit the victim, and that victim can take everything you have from now until the day you die because you were stupid enough to ignore the copyright laws. If you lose the legal battle, (which is VERY VERY likely) it will be a permanent stain on your track record (it will become public record for anyone who is interested to see), and people will not want to work with anyone who has a record of breaking copyright laws, especially in the film making industry. Simply ask permission, if they shoot you down, then hey, there's millions of others just waiting for the chance.

That's my uninvited two cents...

ok, let us see a simple occasion: you shoot a holiday trip film. you cut it and put some music tracks on the audio layer. 1., then you write it on 5 DVDs 1 for yourself and 4 for your friends.
2., or you put it on your website and you tell your friends to watch it. I think less than 100 will watch it in a year.
would you pay for the copyright?

if you make a cool film and you put that on your website you should pay. I suppose that if you do not have any income from the film, you will think the money over again.

so... really.. if you "don't care" as you say.. about hearing 'nirvana' or other music in some home movie type stuff.. what the heck was the point in your original post?

........

?

Umm I think my original point didnt say *home movie* it said * washing and put nirvana as the soundtrack then publish it on the web*

Web publishing was the point. Home movies for your friends is a different matter.

Thanks

If you "film your mum doing the washing and put nirvana as the soundtrack".....

You deserve to be punished......

what's nirvana ever done to you?
