See, the point is:
Characters are never * vital to the story. It can be a man called Max Payne or a man called Thurman Rex. No one is going to care if the story sucks.
Anyway, if it is going to be as good as it get's then why waste everyones time on something that cannot ever grow or be marketed. I never got these Star Wars films; seems a ton more rewarding to invent your own SCIFI and not use someone else's ideas.

I agree with John. Technically even with a fan film, you are in violation on so many grounds to even broadcast it on the internet. To further complicate your situation, there have been multiple lawsuits over even the name of 'Max Payne' so you are setting yourself up for a lot of problems before you get started.
You could do a complete rip off, change the name to Max Penetration or something, and tell the story the same way,but still be above the law. It sucks to invest this amount of time for something that becomes a paperweight.
You might be the biggest fan of the game in the world, but if you are talking about this "amazing" project then you are creating an unoriginal "amazing" paperweight.
I don't mean to dampen your spirits, and if you finish it, I will watch it, but I think you're making a massive mistake. Then again, not my money, time, energy, passion, enthusiasm, despair, desparation, creativity, theft of intellectual property, or whatever. Best of luck

Fan film is a fan film. There are few works out there that are completely original. So much material is copied and copied, that sometimes is mistaken an original. In fact, if someone took an idea long forgotten and brought it back up(remade,) it could be mistaken as an original idea. In the end, one can say any film is a copy of another film. Really tough to be completely original, there's always someone out there that'll say "hey you copied such and such." Besides, improving on an exiting concept/idea is better than a trully bad original. my2cents.
I say do your movie..screw what these guys are saying. Just do it..because you can. You don't need a reason. It's a learning experience and you're doing it based on something you have interest in. If it doesn't work you can always go videotape your kid riding a bike or something. Woot woot.
