Laws regarding underagd nudity?

hey all, a friend asked me to help him shoot a short about nude beaches. I know its legal to do in general, but when there are minors partaking in said nudity, do the laws change? Its not a pornographic thing at all, he is trying to shed more light on the whole nude beach scene.

Have any of you ever worked in such a situation? Any tips or warnings etc?

Everything screams wrong to me. Don't know how it works though and what laws are dealt with, but there's also the issue of the people viewing this footage as well. Despite the fact that it's not pornographic, you never know why people would watch a film like that. So minors that are nude=not a good idea, even if legal or not.

Are minors even allowed on nude beaches? I have no clue how that works either, but I would assume that it's a no. Ask you're friend.

Maybe just be safe and blur out the nudity.

Talk to a lawyer.
Blur or not, your friend is possibly going to wind up with footage on his computer of nude minors. NOT a good thing to have hanging around without being crystal clear on the legalities invovled.

I wouldn't shoot a frame without covering my bases.
 
And this is one time that I would make sure EVERYBODY who is remotely close to the camera signs a release that an attorney has okayed.
 
i would secure an attorney for this one. there is precedent for underage nudity in motion pictures, for example Brooke Sheilds in Pretty Baby, but there is equally precedent for controversary and cries of exploitation. tread carefully. i take it this is a fictional narrative, right? not a documentary? a doc would open a whole other can of worms.
 
Hmm, thanks for all your quick input. I think the idea of him/us talking to a lawer first is a good one for sure. And as far as minors being nude on nude beaches, i am pretty sure thats an ok.
 
Don't do it. When dealing with minors on film they're required to be chaperoned and you need parental consent for an appearance release. This is a bad idea.

National Geographic has been shooting naked natives for years. In England, they have Page 3 in the Sun Newspaper, and some of their models were under 18. So clearly, there are differences in Laws depending on Country and Subject. But this is America, you are going to be subject to these laws, and you don't want to be caught with that footage.
 
I know this issue has been resolved but for future reference I just want to point out that the majority of nude beaches are either private or at least gated. They also have very strict no-photography policies and the people that use them are not very fond of being taken pictures of. If anyone intended to shoot at such a location I would suggest getting written permission from whomever is in charge of the place, get signed releases from ABSOLUTELY ANYONE AND EVERYONE who appears in frame (so basically everyone at the beach) and make sure there are no kids or people of questionable age around. In other words: Stage the whole damn thing.

It's hard enough shooting at a normal beach without getting in trouble - this is just asking for it.

I know, dory, you've already decided. Here's another reason not to do it.

While the original idea for the shoot may be valid in some European countries, in the end the footage can be re-edited and redistributed. Use your imagination.

In Canada, it's not tolerated. At best, alot of explaining has to be done to the police. And I mean your name in the paper stuff.
Glad you decided against it.

That said, I believe all (legit) nudists clubs require you to pass a psychology test of some sort before joining/entering and also ban all cameras in those areas.
 
I think that I would be uncomfortable with shooting minors in any context naked for various reasons ie... content for pedophiles, age of consent, I wouldn't want someone photographing my child nude.
