HMC40 - how do I turn it off??! Help!

Please help! Just got the HMC40...cannot seem to power it down?? I switch it to off, but the red power light stays on. Then, when I try to turn it back on, it doesn't come back on. I have to remove the battery and then switch it on again. What am I doing wrong???!

Called Panasonic...indeed it is defective. Contacted B&H (got it from their used department) and have sent it back for a refund.
