Fact-based screenplay

I was looking to write a fact-based screenplay on the life of some living celebrities. Is it true that I could run into some life rights issues if I portray them in a defamatory way? I have read it is a good idea to consult a entertainment lawyer about these issues because you can easily run into trouble when apply for errors and omissions insurance.

How does a guy like Eminem get away with mentioning real names in his songs or authors who publish conspiracy theories?

I'm no expert, but my understanding is that it needs to be based on facts. You can't 'embellish' it to smear the person / company / name.

Might want to call Michael Moore. He's the expert, bless his heart!!

Michael Moore is a perfect example. Moore's films have facts in them but they are accompanied by his constant commentary. He mentions tons of people in his films, would a group of friends sitting around and commenting on a Tyson fight (commenting on Tyson's outfit, his attitude in and out of the ring, or even quoting/criticizing something an announcer) would that be infringing on someone's private life?

Or similarly could friends discuss what they thought of a movie they just saw? (citing the title, filmmakers, specific scenes, characters, plots points, or quotes)
