ebay advice?

I recently purchased an EX1 thru ebay on the 8th of April. The ad stated that the owner would have the camera upgraded with the latest firmware at Sony, L.A. The seller dropped off the camera on the April 10th. Yesterday, (April 21st) the seller emailed me, saying that the camera still isn't finished at Sony.

Any opinions about how much longer I should give the seller, before asking for my money back?

You should tell the guy you're feeling a little uneasy and that you would appreciate it if he gives you the serial # and phone # for the place he dropped it off so you can call them and pose as him to check on it's status...
