Does anyone know what the law is regarding drugs in film. that is, if a piece of footage has a real controlled substance such as pot or coke, could the producer get in trouble for that, even if it was a documentary which in part was about a certain drug?

Illegal substances are illegal substances, period. They are not less illegal because they are in a documentary. "Art" is no defense.

If you're worried that you might be on the hook for it, don't do it. Or consult a lawyer in your area with details about your situation. Or both.

why show the real drug? You can get things that will look like illegal drugs on film. If the footage is already there, they can't arrest you for having footage of what looks like drugs. It would have to be in your possession...

If you simply need to show the drugs on the table, fake it...

You can get around a lot of that depending on how you shoot it. My very first Music Video had a shot of two guys snorting cocaine. I shot a wide shot of the two with the cocaine on the table. Tight shot of them chopping the cocaine with razor blades and then a medium shot of them snorting it. I think we used either confectionners sugar and/or powder.

* Note: the shot of them snorting...I just shot it in a way to make it look like they were but they were NOT snorting sugar or powder! LOL!

I'm glad you put that disclaimer. it would be bad if DVXusers started to snort sugar powder and get brain damage from it ;)

what if the video showed you how to do something? for example, something showing how to make hash? I wondered if that would be considered conspiracy. ???

Handling any illegal substance period is a bad idea. They're Illegal for a reason. You get caught with them, you will go to jail, whether you're filming or not...

I don´t care about legal or ilegal issues.
But if you film someone sniffing cocaine has to be real cocaine.
Is like tears. You can fake it but the audience will know.
is it ilegal to buy them, have them and ¡¡¡film them!! the world is getting crazy..
Will have to learn all the stupid rules every single morning we wake up. One day i will be arrested and won´t know why.
Put some freedom in your life

..of course its illegal to film it.. if your filming it, your in possession of it. if your using it then your using it. if your filming it it means you also purchased and or made, and transported it to the location.
...if it was ok to do anything you want as long as its for a film then people would just duct tape cameras to their heads.

Well, funny; you don’t actually SHOOT people when you film someone doing just that, and it works out just fine.

Now I'm curious. Does anyone know what they use in Hollywood flicks when the actors are snoking a joint? I was wondering about that when I watched the fantastic "Eternal Sunshine of the Spotless Mind" again last weekend. I'm pretty sure Kirten Dunst and Mark Ruffalo weren't toking a real joint. So what, do tehy just roll regualr tobacco to look like a joint?

not sure.. but its likely cigar or cigarette materials.. it couldve been CG smoke for all the audience would likely notice though.. just dont burn or inhale anything poisonous. ;)

You won't get charged for drug possession if someone sees a film where you use real drugs. There's no way to prove that the drugs are actually real. No lawyer will ever be able to prove that by simply watching a film that real drugs were used and will charge you. You could just have a REALLY good actor.

The real legalities come in when you're on set with the real drugs. A cop could bust in while your filming and arrest you for possession of illegal substances, so why use them when filming? Having footage of drugs isn't illegal because it simply can't be proved those drugs are in fact real no matter how real they look. You can make fake drugs that look just the same as the real stuff on film, those people that make films of that aren't arrested AFTER they make the film.

I wouldn't recommend having or using real drugs at all though or doing real drugs for that matter, it's just stupid...

There are many ways to prove it. I'd find a way.
