Copyright soundtracks?

Hi - not sure if this is the correct forum for this question - but here goes ;)

I've noticed that a lot (most) of the videos uploaded to the sharing sites have music soundtracks that are almost all still in copyright.

Is it permissible to do this, providing you also state the title/artist's name/album, etc? - or is it just a case that no-one will bother as long as your video is non-commercial?

TIA

Copyright is copyright. If you don't have permission, you cannot legally use it. It does not matter if your work is commercial or not. Once it leaves your computer and enters the series of tubes that is the Interweb, or is otherwise shown in any public venue, it is a published work and is subject to copyright laws.

Lots of folks do it anyway, and the hosting sites are starting to crack down on it pretty hard. That said, YouTube does have a list of published works that can be used, and in return the video gets an ad imbedded for an iTunes download of that track. But outside of Creative Commons, or direct permission/license, it should not be used. Do so at your own risk.

Thanks - that's pretty much what I assumed. My query was prompted by the fact that most of the Vimeo stuff has a copyright song or tune as a background.

I'd noticed that the creators usually make a point of attributing the music that they are using, and wondered if this somehow circumvented copyright law.

Obviously not.

Cheers.

The Institute of Videographers do an MCPS licence that allows you to use copyright music.

Contact the IoV for the full details and what is allowed and what isn't.
