BlackMagic Intensity - HDMI Capture of HDV

Ive been having problems capturing JVC HDV footage.. I went and bought a BlackMagic Intensity HDMI capture card to use with my JVC BR-HD50 ProHD HDV Deck... Apparently JVC puts HDCP into their decks and the HDMI capture card sees this stream as copy protected and wont capture it (captures all green like copy protected footage)!! What kind of bull is that... Does anyone know is there is an HDV deck with HDMI without HDCP??? Or does anyone have success with the Intensity Card??? Let me know!! Cause the HDMI capture card captures HDV and encodes it realtime to DVCProHD makes for smooth editing... Say bye bye to long render times... if i can get it to work!!!

New update to the firmware of the BR-HD50 is now out v1.08. This is supposed to correct the HDMI problem. However, I have had no luck capturing with my Blackmagic Intensity.
Has anyone else had any luck?

Why on earth would you use an HDMI stream for HDV? I thought the whole point of HDMI capture was to get uncompressed...
