Wet poodle
Hey guys

My friends are in a bit of a stint and I may be as well

3 months ago I referred two of my editor friends to this business located across the country - the boss of this place sent them harddrives with footage, they cut the footage at home and sent it back - 5 weeks ago both of their checks bounced - he has sinced refused to pay up, you can't communicate to the guy, they don't pick up their phones, etc.

Anyway, he owes them combined over 2k - I became really pissed and a week ago I started calling their business 3-4x a day and sending emails to his assistant and to him (none of these messages contained threats) Basically now he's saying that he's turning this over to his lawyer because I was "harrassing him" and slandering him.. what the f?

I hate this guy..

what should we do? Should we be concerned with his threats? Should they keep phoning him ? Or should they just take this to small claims court?

If they file in California, will he be forced to fly out here to appear in court ?

ugh..

What does he think he would accomplish by taking you to court for harrasment or slander? He owes you for services rendered (no pun intended, but its funny), right? The fact that he wrote checks which BOUNCED is a problem for him. I think the guy is just blowing smoke up your whatever with the lawyer thing, but I'm no legal expert.

maybe a real legal expert will come forth and reassure you.

Good luck!

Oh yeah, mean people suck!

I didn't sign anything because I'm not working for him however, I'm pretty sure my friends didn't sign anything..

shoulda coulda east-wooda

Bouncing the check will get him in trouble. Have your friends contact the guy's state attorney's office and document the fraud... the rest is all in the hands of the state. The
sad part is that the guy screwed himself by signing the checks. If he did nothing and
just disappeared, there would be little your friends could do. Those bad checks are
a seperate crime and even though they will probably never see the cash, your
friends should hope for the day that the guy gets pulled over for a traffic stop :)

The fact that he wrote the checks in the first place is what going to screw him. That shows that he gave them the money and it didn't go through obligating him to have to pay up.

Contact the local DA and report the check fraud. Let them know it was across state lines. This should make it a felony.

The local DA will advise if you need to contat the DA in the city where he resides.

You may not get your money, but you might be able to prevent him from screwing more people.

I'd rather not list his name and business here on the site

However, I would glady PM you his info if you're interested !

:)

Your friends could have a lawyer send the creep a letter. Often a letter is cheap (compared to actually suing someone) and has the effect of scaring the guy when he realizes you're getting serious about your claim. I'm curious what the footage was going to be used for. Because your friends own the copyright in their work, and without a closed deal (i.e., payment) the creep can't even use it. He can't make DVDs of it, he can't post it on the internet, he can't broadcast it, na da. Maybe someone should point that out to creep.

Two things:

1) file a case on People's Court. It may not do you much good, but come on -- you'd get to be on People's Court! :) Plus, since the check bounced, the judge will likely throw the book at 'em. And even if the judge rules the other way, I think you still get paid for appearing, don't you?

2) One of my friends had an awful time getting paid from one guy. So he called up a Hell's Angel and said "can you please just stop by so-and-so's place and ask him to finally pay?" It worked, the guy paid... although I'm not sure whether the biker ever gave Pat the money or not!
