Help! Screwed for $1215 on DVXUSER by user: gonzoish79

Ismael/gonzoish79/munchies claims that a third party "mail boxes etc" type place stole the card from the envelope - not fedex. although this is problematic as it needs to get resolved between fedex/mail boxes etc/ismael - my issue is that all of this has nothing to do with me, besides the fact that he has my money. It should not be up to me to try to resolve this issue with his thrid party shipper. he should be repsonsible to refund my money on a prompt time line and recoup his insurance due to the stolen card. I was in contact with him for the first 6 weeks that this happened and now he seems to have dropped out of contact. So it is either entirely a scam or he is having issues recovering his insurance money. regardless he should be transparent and honest about the entire transaction.

I am tiring of trying to be "cool" about it and am going to file a criminal charge against him with the police.

I will keep you all posted on the progress.

re: researching him prior to the transaction. i did search all of his posts and he seems like an active dvxuser and had a decent background in selling items with the exception of one 8gb card that he did eventually ship out.

re: paypal - there is no coverage on items that are not purchased through ebay and as i had the amount in my account at the time I did not go the credit card route, which could have protected the purchase via a charge back.

no way dude, I have been shipping with ups and fedex for years and never heard of any package being opened, maybe back in the day but not recently
like I said, its better to just steal the whole package all together, not going though the drama of all this BS.

Hundreds of people have their cars stolen every day. Just because it hasn't happened to you doesn't mean it doesn't happen.

The point of not stealing the whole package is that they could determine where the package was stolen from and eventually catch you if theft was your usual routine. If someone opens it and the contents go missing along the way, who knows where it went missing? Rather than cast suspicion on FedEx, that doubt is now spread across the shipper, the shipee and everyone in between.

Anyway, how do we know he didn't receive the package and just claim the contents were missing? I don't know feltsoulmedia from a row of fence posts. I do know Ismael and he's always been on the up and up with me.

Your opinion sucks. But hey, thats just my opinion. Every company has employees that steal - however Ishmael has been a member of this community for a long time and to think he suddenly decided to start ripping people off outta the clear blue seems kinda ridiculous (especially when many of us know where he lives).

ohh my opinion sucks now? ok now you are getting offesive probably because you are vouching for your friend that should be here explaining insted he put you to post for him is that right? dont ever say my opinion sucks, thats what we are here for, this is a forum on the internet where people can express their opnions in a creative way

stoped, I just hope the situation gets resolved asap, dont wanna lose the marketplace, I have sold and bought a lot of stuff inluding from Jason Ramsey and I would hate to lose the oportunity for members to buy and sell awsome grear :)

He's not my friend and I wasn't getting offensive, I was getting DEfensive. Look it up.

I have had first hand experience of FedEx employees stealing on several occasions. Ishmael sold me something on the up and up, wasn't afraid to let me come to his house to pick it up and answered his phone regularly. He even called and offered me camera gigs for a period of time. My experience tells me to give him the benefit of the doubt.

Honestly, if you were in a similar position: sold something, shipped it insured, it got stolen along the way - how would you deal with it? From reading the posts it sounds like Ishmael hung in there for six weeks or so before he washed his hands of the whole affair and left it up to the insurer. I don't know what else you expect the guy to do.

This is a tough situation - and I hate to call people a thief without all the fact, that said though its the sellers responsibility for a missing item - END. Regardless you should be given a full refund without delay. Thats what senders have insurance is for.

these situations are all hard to deal with and it sucks. i got ripped off on ebay, but then i realized that it was in fact my own fault. i am not saying that it is your fault FeltSoulMedia but i think it all comes down to being smart. After i got ripped off on something i was very careful before purchasing again online; however i did buy a dvx100b bundle here on DVXUser but made sure to read all stickies and threads pertaining to fraud. I got a home phone number that I cross checked with the public phone listings for his name and called it once to speak with him. I think any non-scammer would probably feel better with a phone call as well. I am just saying, lets not leave it up to the Admistrators of DVXUser to do our tedious safe work, we can do it ourselves with the same results.

PS I dont think there should be a post or time requirement on the marketplace only because i got my camera after only just joining that same month - but i had been looking at these forums for a while. just like everyone else, this is my 2 cents

Noel Evans, I'm not sure it is that simple. once an item ships there is nothing the seller can do to protect himself, assuming he did everything right, insurance and what not. I sold many things over the internet luckely out of all of those only one item had a problem, a old claam shell ibook, when I shipped it, it was fine, when it arrived the buyer said it was broken and wanted a refund, as it was fine when I sent it, I told them to go to there local post office to file an insurance claim.

I'm not sure if she ever got the insurance pay out, as she kept badgering me, so after paypal came down on my side, I cut off all comunication with her. things happen, once the item is shipped, the seller can not be held responcible. now this is assuming the item was actually shipped.

I have to wonder, there are actually 3 possible reasons for this happening. we've only been talking about 2 and ignoring the 3rd

1. the seller never shipped it. this seems to be the mass bandwagon. and its what the buyer is claiming.

2. seller shipped it, fedex/mailboxes exc stole it. there are a few who are following this idea as most likely.

but there is a thered and my reply to Noel about the laptop i sold made me think of this, because this is what I believe happened in my case.

3, Seller shipped properly, fedex delivered, buyer got the p2 card, and wants both card and money so has fabricated a story, and is trying to ruin the rep of a sellerand pressure a refund.

now in this case I doubt its 3, but if we are going to talk about the other two, and try to find ways to defend against it in the future, I feel that 3 should also be in the mix, as it is very possible that it could happen to any of us at any time.

oh you sent me an empty box, i'm filing charges, it can't be proven either way, its a case of he said she said sort of thing.

I guess my point is, be carefull jumping on bandwagons, you know what happens when you assume right?

also, buyer and seller bewareyou can talk on the phone, but make sure you keep all emails, or pms, at least untill a public decleration of a happy buyer has been made.

I feel that if this were the case, the seller would have spoken up by now and presented his side of the story, convinced of his innocence. In any case, somebody should definitly try to get in touch with him, hopefully it can be resolved in a civil fashion, without pressing charges.

Maybe you didn't see this:

First off: what could you possibly care?

Second: why is it that on every forum the administrators have this 'everybody must get along' God complex? People disagree. Welcome to the world. You don't need to be the thought police.

But people don't have to make things personal. It's a rule here. If you don't like it, go find another place to hang out.

Disagreeing is one thing, making things personal is another.

because you don't run this form, you are a member and moderators have rules around here to keep it al good, anyway I hope I am wrong but I have a feeling
this thread is headed for a close
