Hello Dvxusers,
I am trying to resolve an issue with gonzoish79 from an attempted transaction to purchase a 32gb P2 card back on 4.1.08. Here is the story... If anyone has advice for how to get this resolved, I would really appreciate it.
I ordered a Panasonic 32gb P2 card for $1215 via www.dvxuser.com from gonzoish79 on the forum. The seller sent the card, so he claims via fedex. An envelope arrived at my place in Colorado with the case for the card, but no 32gb card. I immediately contacted the seller upon receiving the empty case. He claims to have sent the card and that it was removed by the shipping company. I gave him the benefit of the doubt and let him file a claim with fedex which he said would be resolved within one week. It is now 8 weeks from the original date of the transaction and I still have not gotten a replacement card or a refund. This despite the fact that on several occasions the seller has promised to send a replacement card. I have even supplied the seller with an overnight shipping label and paid for the shipment to be insured. At this point I just want my money back, but Ismael has basically cut off communication.
The seller insists that it is now my responsibility to see that fedex refunds his insurance claim and then he will refund my money, but after repeated attempts to get the info necessary to follow up with fedex, i have not means of reaching out to fedex - which i do not feel is in anyway my responsibility. The other issue is that he sent the p2 card from a third party "mailbox plus" and fedex is having an issue with this.
Here are the steps I have taken thus far.
4.3.08 Requested the $1215 via paypal
4.3.08 Filed claim with paypal
4.3.08 Filed complaint via www.ic3.gov
4.3.08 Filed complaint with BBB of LA via their website
I have been in touch with the seller, but he is insisting that he has done all he can and that now it is up to me to get the money back. I am having a hard time seeing this logic as I had nothing to do with his choice for where to send the card and for insuring it while in transit - and i paid for insurance in the purchase price. Would this make for a strong small claims case against the seller? Would he be responsible, if i won the case, for my travel and legal fees? He is in california and I assume I would have to file the small claims there?
