Tape Taken By Cops

I was just at a public event that included an NRA type of organization.

As I was about to enter when I was told... "No Cameras".

I almost argued with the guy, but figured...its smarter not to argue with dudes with firearms.

If you they gave you a ticket(criminal citation) for trespassing then consider that being arrested! It’s still a misdemeanor and they don’t have to physically book you into jail or Mirandize for it to be considered an arrest.

As Silverwolf said the tape was probably taken for evidentiary purposes and may never be given back to you.

Depending upon the ages of the others involved(under 18) charges may have been referred to the prosecutors office which explains why they weren’t cited. Won’t know till you read their report, Good Luck!

I film skateboarding alot also. You just gotta face the fact: this is a run and gun type of deal. It's very unplanned and you just do it, don't ask if you can do it or whatever. That's why it's pretty sketchy to do, but like alot of the skate board filmers, I skated before I started filming, so it isn't anything new. I've been given alot of trespassing warrants for just being there with my camera, but last time I checked, trespassing is just being on the property when you're not supposed to, not just skating. Sounds like you got some crappy luck with the fact that all the skaters got off the hook, but I guess see how this whole deal plays out and see if you can get your tape back from the police station or where ever they have it. Just ask questions to the people there.

Also, I would check www.skateperception.com Search the forums there for your question, I'm positive it's came up before on there.

In the spirit of truth let's at least tell it like it is... skateboarding videos where people do flip kicks or ollies or whatever... aren't interesting... it's rail-grinds and tricks that happen as part of other grinds or jumps. In MOST cases skating involves a certain level of property damage. Nobody wants to admit that though... but the property owners are pretty clear on that. If it was JUST trespassing then the property owner probably wouldn't care... cut through some private property on foot... and even FILM it... and I'll bet you can do that a thousand times with no issue. The other fact of GOOD skating videos is that people sometimes get hurt... when the property owner knowlingly allows you to do something dangerous on his property he is accepting a potential legal risk. So don't expect any property owner to be cool about skating ever.

Film what you want, do what you want, but be honest with yourself about it... that's why you gotta' do these shoot guerilla style... accept that. Get in, get your shot, and get out fast. Converging on a location to get good skate video is going to involve some disrespect of the property OTHERWISE NOBODY WILL WATCH YOUR VIDEO...

Option B is film at a skate park.

I have no problem with guerilla filming... I don't think I'd create that much without it... but when you're operating in gray areas be ready to accept the risks.

Option C: Use an HVX in P2 and keep a tape loaded for the purpose of handing over to anyone who asks. Three-dollar insurance. There might be two cops on the planet that would know you're giving them the slip.

Of course, this isn't really good advice, but it certainly would work. Better advice is to secure your locations properly, post your mass-release notice and keep it friendly and professional when the fuzz shows up.

haha if only my friend that did get away with the HVX got busted instead of me. HEY you guys, well some of you guys, ive been doing this for awhile i know why i got busted for the last time. i know the consequences. just didnt know they could take tapes. wanted to know how to get it back and now i know so wish me luck. thanks again you guys.

Just remember this truth: "the police are not your friends". It is not the job of the police to make your life easier. Keep that in mind when they stop you for any reason whatsoever. Know your rights. Give them the minimum cooperation required by law. That's all. As you have seen in your personal experience here you "got along with the cops well, very friendly" - fat lot of good that did you... they still took your stuff. They'll enforce any law, whether a good law or a bad law - that's what they're paid to do. Your job is to protect your own interests. Use every trick you can - since that's what they are doing. Good luck!

And next time, don't rely on "someone" saying it's ok to be there.. have someone of proper authority (like the property owner) sign a release that states that you can be there. It's this kind of a situation that release forms are explicitly meant for.
