When do you have to ask for permission

At what point when developing a movie idea or writing a script should you ask for permission if your 'basing' it off something else? Like how Constantine came about. Based off the the Hellblazer /Dc comics stuff. I mean did they just get inspiration from it? or Did they have to go and buy rights to used likenesses and stuff like that?

Say the thing did'nt have copyrighted characters but you wanted to use some story ideas from different works that are somewhat specific? Do you have to contact the owner of those works even though your not going to used theire specific writings?

This might be more specific: i.e. Say you were making a movie that used the general ideas and rules of the world in The Matrix. like how they interacted, the 'backdoors' using exits and all that, but you didn't use any of the characters, music, likenesses, etc... just the rules of that world. Would you have to get permission for that?

And like the 'based on a true story' movies.... what about that?

Good question. Many movies are direct ripoffs. They seems to get of fine. Often it worse when you steal someones script and make it into a movie before he even made a penny on it.

Thinks there is a very fine line between what you can do.

Buy the way I dont think the makers of Hot Shot Part Deux ask Rambo producers if they could do it. :)
