Using Music in a Video

hey guys...

I have an documentary I am working on where people are dancing to a song that is on the radio in the background. The plans are to sell this video online as part of a larger collection of documentaries, do I need to get rights for this song that is playing or is it okay to use because it was on the radio?

What about in a situation where people are listening to a CD in the car during a conversation and talking about it? Would I need rights to that? I'm not sure where the lines are drawn on these kinds of uses but I want to make sure that we're in the clear when we're done with this thing.

thanks for the help guys...if anyone wants to add some links to sources or other threads for people who don't know where to go to aquire rights or if anyone wants to link to other sources that talk about penalties for using copyrighted music, that'd be cool with me. i got the answers i needed!
