Using images in a film?

In a short I am working on I plan to use an image of a web smiley that I found on the web. It is similar to hundreds of other available on the web and you can download and save it for free.

Are there any legal issues with using a web smiley found on the net? Do I have to get a rights for it?

Any help would be appreciated.

If the sounds and smiley's are distinct to AOL, I would suggest you look into getting clearance for them if you ever plan on selling your film.

Why not just have an artist do a smiley for you and get a composer create a sound for you? Then you can own that when you file your copyright.

I try to stay away from stuff like asking time warner for use of their property. it just smells bad to them and they'll basically say no by making it expensive in my experience.
