Alright so typically we do wedding videos, in which we need to tax all of our services by law. Recently we got hired to do some editing for a law firm. They provided the video and we just put it together, burned 3 copies and mailed it back. I believe that since I am in CA, the law states that if I provide a physical copy to an end user (i.e. they aren't selling the dvd's now) that I charge tax for all services involved in the creation. However, I am now second guessing myself as I looked into the BOE section 1529 of what classifies as a motion picture tax exempt. That seems to include any corporate videos, but it might just be advertising and commercials for them, not a video to be used in a trial.
We are based in CA and our client is as well, does anyone have any similar experience or knowledge on whether or not I charge sales tax on the service?
