Super Hero Fest Violates Trademark

I just thought of a work-around. All is not lost.

Jarred will have to do a Search-and-Replace in the HeroFest forums, replacing all instances of "Hero" or "Super Hero" with "Noir".

So "HeroFest" becomes "NoirFest", etc, etc.

PM me and I'll send an SQL statement that will do the conversion.
ROFL, nice

Yeah, or like some company trademarking a simple word like the plural form of the word 'window'. What will they think of next??

"Windows" is classic trademark -- using a figurative word to brand a product.

You know, much like trademarking a fruit to describe a computer.

actions like this is why people get pissed and start hacking corporations and pirating stuff....endless cycle

pmark23. i went to bed last night thinking you were joking and I wake up the next morning and you're a still at this.

Give it a rest. This is ridiculous.

Make Jarred change the whole fest over a word in the english language that isnt EVEN trademarked yet and most likely won't be trademarked??

I don't think so.

Um...didn't the registration info get posted on the previous page? Like from 1967?

But don't worry. If Marvel or DC gets uppity and actually tries to do anything about it, they'll wind up spending a fortune on the boxes of kleenex they'll be crying into when they lose.

Aye, that's my point.
Marvel/DC's attempt to get SUPER HERO TM'ed is NOT that far fetched, and I bet stockholders are already drooling for a positve [in THEIR eyes] outcome.

Once they get it trademarked they can do whatever they want to whoever is illegally infringing on their trademark, such as website forums running filmmaking contests.

Sure they may be on shaky ground, legally -- but I bet they have a lot more lawyers than DVXUser does.

Why risk it? After all, we've already given up on our rights of fair-use. This is just the logical next step.

Isn't this known as spreading FUD (fear, uncertainty, and doubt)? And don't people get banned for such?

Yeah, that goes way back. Jobs vs. The Beatles. Grudge match!

The grudge match is becoming an easier battle with two of the Beatles six feet under. :cheesy:

I agree, Terry. Cut the crap, pmark. :banned:

You seem to plow right through the fact that this is HERO FEST, and the trademark concern is SUPER HERO ... so I realy have no idea why you insist on this rant, when it has ABSOLUTELY NOTHING to do with this fest's title.

GenJerDan, I think that's what Filmjunkie was referring to ... that HERO's not been trademarked, etc.

To trademark a combination of words, perhaps. To trademark just ONE word, that existed long before they did? Nope.

especially when you could just call it something else other than Super-Hero fest rather than actually change the theme

how about
Vigiiante Fest
Super Duper Crime Fighter Fest
Masked Dudes Fest
Caped Crime Fighter Fest
or
... er ... I dunno ... Hero Fest? maybe?
