It's virtually impossible to find music that isn't protected by copyright - what it'll cost you to use it is another thing entirely. Even if the melody and lyrics themselves have entered the public domain, any recording of it that you find will almost certainly be copyright.

The only way you can obtain music that is truly free of copyright issues surrounding your use of it is to compose and record it yourself, either using conventional instruments or by using digital music tools such as Sony Acid, Sony Cinescore, SonicFire Pro, etc.

If you don't have the musical chops to roll your own, you need to research royalty-free music purchased from buy-out and needle-drop libraries. You may be able to find some that is available at no charge for your project by looking for music released under the Creative Commons licensing scheme. An online library that I've found that has very reasonable licensing fees is Magnatunes.com. Another good source for production music is Sounddogs.com. A google search for "production music" and "royalty free music" will turn up loads more.

http://incompetech.com/m/c/royalty-free/ - its protected by copyright but its a $0 license, all he wants is credit. Double check his licensing, but I'm almost certain thats the policy. Otherwise there are some free to cheap composers out on the internet, as well as indie bands depending on what you are looking for. They'll all still be copyrighted, but will sometimes license stuff for credit only.
