Hi everyone, I'm talking with a screenwriter to help me co-write a short piece for my thesis project. He wrote this as part of the agreement that I'm still looking at. I need your opinion on this. PLease read it and let me know if it sounds good to you. remember this is just a student film I'm gonna cowrite with this gentleman.

He put this on his email:

I get 10% of any back-end gross profits IF this thing gets picked up for
> distribution. 10% profits are AFTER you recoup any 1) production costs, 2)
> investor costs, and 3) marketing costs to place into film festivals (1, 2,
> and 3 costs capped at $50,000).

Dov SS siemens writes in his book From Reel to deal:

Profit participation: If the selles hesitates, your final incentive is to give him a percentage of profits-but never a percentage of the GROSS. (close quote)

let me know what you guys think.

My take. Most shorts make little if any money. Therefore, do you really want to be holding on to reciepts and sending out small checks here and there for the rest of your life? That would eventually get a be a real pain in the rear. If you must have this person write, I would say pay them a buyout fee and you own all rights to the script.
