Release forms?

Just run a search for "actor Release" I found a number of them. Just make sure to read it carefully and make the necessary changes. That is how I developed mine.

You don't use releases for music so you aren't likely to find any. While you would get releases from the talent if you're recording a performance, the music itself must be licensed. You license it from the owners of the copyright to the words and melody (typically the publisher and composer) and, if you want to use an existing recording, you also obtain a separate license from the copyright owner of that specific recording (usually the record label that released it).

But the question is who wrote it. If someone in the band did, they can grant you the license. If you recorded their performance, that's all you'll need. But if they performed someone else's composition you'll have to track down the original composer/publisher. But it's important to realize that a license is NOT the same thing as a release and they deal with completely different issues. A release grants you permission to use somone's likeness and protects you from their suing you later; a license allows you to use copyrighted material that owned by someone else in your own work.

Are they represented? If not, then a quick form stating that they give you permission to use their music (best to get every member's signature on the form) on your project. If they are, you must deal with the agent as well.

Outline how the music will be used and what, if any, payment they will receive for that use. If there is no pay involved, then state it. Make sure that they understand that their music will be associated with your project for as long as the project exists. I will see if I can dig up the releases/license form we used on the Internet radio show. We only played unsigned bands and had a form that covered us.

The band is unsigned..however is there a way i could find out? I tried to look up the title of the song in the USTP site but couldn't find it.
