Product Placement

I have a couple questions concerning Product Placement/Usage Rights for a film. Does anyone know who, when dealing with a company's marketing department, has the authority to sign the Release Form and is there anyway to guarantee that you have got the right person? In addition, who signs off on the release form when dealing with a Product Placement Company whose client you are trying to get clearance from. Then, after the company signs off on the release what powers do they have in terms of the way their product is used? What happens if they see the movie afterwards and don't like the way it was used even though they approved the script? Can they do anything or are we safe once they've signed the release? If anyone can help me out here it would be a greatly appreciated. Thanks!

On all legal matters where you are concerned about protecting yourself and your company, always consult an attorney. Seeking legal advice from strangers online is risky.

Good luck!

It's good advice, but I don't blame him for asking for advice. My attorney charges $375/hr, I'd rather not consult him for anything. If I made one phone call to ask him how he's doing I'd get a bill the next week for like $500. haha

Well the thing with product placement, if you are using a firm to do it. Everything they have has pre-clearance. They need to approve the script, and see if the company in question would indeed allow a product to be placed or integrated. Some don't like horror films, others don't like blood.

In terms of what happens if you write that the kid sips on a coke, and in the final version, the kids hand covers the coke logo. The company has full right to sue for their money back - since you didn't place the product to spec. Or if you throw the coke can on the ground. Promoting littering. They can sue.

It is a very very very tender spot to play in. The marketing department of a firm should be able to tell you who needs to sign it. As well as the firm you use for product placement. Best I can do for you.
