lately i have come across a few post about stealing copyright material. I have downloaded a few things in my time but when I think about it it has always been good for the artist. For example I downloaded a copy of "Winged Migration" I heard about it online, checked it out online then purchased a physical copy. Two of my friends did the same. So the artist sold three copies that would never have happened had I not ignored the piracy trip. I have also downloaded a few things that are no longer in production. These items I have purchased and lost two or three times over. In purchasing these videos/cd's three times I believe I have paid my dues to the artist and production houses. If they choose to stop production then I believe I'm backing up what I've already paid for.
I have also downloaded songs that I own and have paid for because I'm too freaking lazy to ferret out the cd, record it then flip it to mp3. Does it matter where I get my source material if I have paid the artist already? I am in no way promoting or advocating piracy or theft of other peoples work but I don't think you can throw a blanket over the whole issue and say 'theft is theft" Am I wrong here?

Re: Piracy and theft?

Under the law you are. THe ethics of it are more debatable I suppose. The challenge with all of this is that the technology is so new that the legal system can't really keep up with it. At least not yet. Citing some of your examples, the artist might not have a problem with it, which is probably closer to the spirit of the law. But under the letter of the law, if you take it without paying, it's stealing.

Re: Piracy and theft?

So I'm going to upload my wheezer cd to my meager web space (no links to it just virtual storage space) then I'm going to download a cut when I want to hear it...Stealing? My point being what does it matter who uploaded it, I own a copy of the CD.

Re: Piracy and theft?

No, I don't think that would be illegal. You are just storing it for later use. You aren't taking anything.

Re: Piracy and theft?

I had a bath! I think the first one could be a legal issue. It would maybe be like stealing a coat from a department store, wearing it for two weeks, then going back in to the store to pay for it. Man I got the guilts so bad I,m uploading "winged migration" to the site I got it from and I'll never do it again :'(

Re: Piracy and theft?

If I'm not sure I'd like something, I go to the library. It's free and legal.

Re: Piracy and theft?

I'd be crawlin around on a cane before my library got anythig up to date :-/

Re: Piracy and theft?

Vancouver is a pretty big town though. oO they have an on-line catalog you can search? The system here (Denver) lets you search the catalogs of just about every library in the state, including universities. You just place a hold and they send it to your local branch when it's available. Maybe your system has somethig similar.

Re: Piracy and theft?

yep it's so big I heard they'te gonna start callin it a city. I get your point I just never liked libraries. probably a hangover from being a hyperactive child and getting the SHHHHHHHHH! thing every time I went. Now I'm scared... Maybe the copyright police are onto this thread. Soon there maybe a knock at the door!!

So the security guy at Best Buy forgets to lock the front door one night. You steal some games, a few DVDs and some CDs. You're busted and at your court appearance you tell the judge "Hey, it was the security guys fault".

Don't get me wrong, I'm not a digital age angel by any definition regarding mp3s, cracks or whatever but software companies view their products just as any company with a tangible product does and they'll go after you if they find you, trust me (and if you crack something and some idiot gets busted using it he/she will burn you the moment the word "Federal" gets popped out). And that Best Buy analogy is essentially what you’ll get from your lawyer and prosecutor.

Dude leaves his keys in his car, you take it, it the car owners fault then right?

There’s an underground marketing story from a major label regarding a Radio Head record (not the last one, the one or two before). American radio had discounted Radio Head for a while so their label and/or one of their marketing firms “leaked” almost the entire record into the mp3 world before the release. Result: The absolutely best American launch of a Radio Head record ever. They seemed to try and bury that fact though.

Mp3s are the independent bands new air play and it’s crucial for them. It was just abused so badly that the RIAA had to step in yada, yada, and that has clogged a lot of channels for emerging groups unfortunately.

I was in a band that was signed to Sony Music (Sex, Love And Money or SLAM, the one and only record was called “Era”, long story) and had passionate debates with our A&R guy about the beauty of mp3 promo (I was for, he was against). I do know that you generally don’t catch grief if you own a copy or receipt of a download and you’re popped with mp3s. It’s just like software, if you can get a license before the SPA (it’s now the SIIA) gets there you’re golden.

Bands want fans for shows and merchandising, longevity and also publishing (radio, TV, etc). We were given 0.11 per record sold AFTER the label recouped all of its expenses (recording, marketing, etc). That’s eleven cents per record split 4 ways with a 15% cut from each for management after a six-figure recoup. I still make publishing money for an NBC made for TV movie we were in briefly (“Love's Deadly Triangle: The Texas Cadet Murder”, it still airs on cable) and I’ve never gotten one dime of royalties (they also recently refused to turn over the masters).

I could go on and on about this, sorry.

Re: Piracy and theft?

Hey, if people want to download or steal, then let them. Let them learn when the FBI comes one day knocking at their door. That's what happen to a friend of mine. She had thousands of Mp3s on her drive and one day she got busted. She never downloaded agian.

Anybody got a copy of magic bullet? :)

Yea, I got my copy when I payed my $500 registration fee for DVXuser. ;)

Actually the Magic Bullet deal starteda month after I bought my DVX. I'm still bitter, please don't bring up Magic Bullet anymore.

Re: Piracy and theft?

TC, whats there to be bitter about? I don't have magic bullet but yet I'm able to achive the same looks even more with just using the basic filters that comes with Premiere, AE, or photoshop.

Re: Piracy and theft?

Yea, I'm running the Adobe suite too. So I'm not really bitter about missing out on something that I can't achieve. It's more that I missed out on some free stuff. :P
