Open Source (CC) music and effects for NON commercial work?

Hi
Does anyone have a favorite source for music tracks, and or effects for use on personal projects?
My understanding is that most CC licenses allow use of sound on non commercial work as long as you credit the original artist.

If anyone is profiting from the work, then you're violating the non-commercial clause in the CC license.

That said, I've never found a particularly great source. Googling for 'podsafe music' is an okay place to start.

For sound effects you could check out FreeSound.org. Read all of the legal mumbo-jumbo carefully, but you can use sounds from the site for just about anything except advertising and promotions as long as you give proper attributions.

from FreeSound.org:

When using files...

When using samples from the freesound you need to 'attribute' the use of these samples. All samples you download are prefixed by their ID so you can easily find them again on freesound.

There's also the "attribution page" which lists all samples you've downloaded in the past with their details (users attribution page). Failing to attribute samples is breaching copyright.

Do not use samples in ads/commercials. The Sampling+ license does not allow you to do this.

However, you can easily contact the creator of the samples and get the right directly from them!

For anything else, see the legal aspects of freesound.

For music Moby gratis and This guy both will let you use the music for free in non commercial projects and have a way of upgrading if you need to go commercial at some point.

To the non- profit post. No legally there is no difference if you make any money or not. You can't use other peoples sounds (this includes SFX) with out permission and show your work to anybody out side your home. It even gets dodgy if you show it to friends. That's the legal position. People often "get away" with a fair amount of infringement when there isn't any money involved. BUT the operable part is "get away". You can park at a meter and not put any money in and "get away" with it but every once in awhile your going to get stung. How much risk your willing to live with is your call but there is no "it didn't make money" get out of jail free card to play.

Thanks. That was my understanding. Just am surprised by the amount of unedited commercial music being used for 'personal' projects on sites like vimeo. Even if crediting the artist, I'm not sure its something I'd be comfortable doing. (although almost everyone DOES seem to be doing it)
I assume a 'safer' alternative would be to source music and effects labelled with CC on freesounds or archive.org?

IMHO, as soon as it's posted online on a service like Vimeo, YouTube, etc, a video becomes a commerical project, even if it didn't start out as one. Those sites are in business of advertising to viewers, making videos available online in order to attract eyes to the ads that they sell. That's as much a commercial use of the video as is that of a television broadcast station that shows programs and sells advertising. The fact that Vimeo or YouTube don't pay the program's producers for their content is irrelevant. If the video is something like a wedding video, where the producer actually got paid to create the content, it's a double whammy - commercial because it was produced in exchange for a fee and commercial because it's posted publically on a commercial website.

A little kicker for those above the US boarder is that copyright infringement is a criminal offense in Canada not just the civil one it is in the US. So it's not just IF they catch you and give YouTube a take down notice, you could be looking at spending some quality time behind bars.
