The ITC investigation is presently in a brief period during which the ITC has invited public comments on questions that ask whether issuance of a general exclusion order (or alternatively a limited exclusion order) in the investigation would affect the public health and welfare in the United States, competitive conditions in the United States economy, the production of like or directly competitive articles in the United States, or United States consumers. The public comments must be received by the ITC by October 17, 2012.

Anyone with an interest in this aspect of the video, broadcast, film and photography industry may view the ITC’s invitation for comments at http://patentfreeled.com [include an exact address that will lead directly to the Notice].

another quote
An immediate effect will be the elimination of market competition and a consequential spike in the price of LED light systems that can be used for stand and camera-mounted video, film, broadcast and photography lighting. Such a ban will decimate the current variety of LED lighting systems available to people involved in all phases of video, film, broadcast and photography industries, including nationwide film productions, television, medical, law enforcement, event producers, students, churches and other industries involved in the production of broadcast, video, film and photography.

edit:
this affects all of us, please have a voice
I don't want this thread banned so this post here at dvxuser is neutral, remember comments can be pro or con.
This thread is to raise awareness that you can comment at the link provided and the ITC will listen until the 17th

Signed.

This really is insane. It reminds me of the time when Color Kinetics patented RGB color mixing for LEDs. That meant that anyone that created an RGB LED fixture had to license the right to do that from CK and drove prices up. Once again, here is another example of how obtuse the USPO is.

LP invented nothing. If the USPO thinks otherwise, then a serious major overhaul is needed there, or else others will take already patented or expired patent ideas and re-patent for the "use" or specific application to be used with the product. I really do not believe one can apply for and get a patent for particular uses of a product, as one has the right to use a product in any way he or she desires. Has a tripod been patented ? if so, then I will go ahead and patent a tripod for the specific purpose of supporting a camera. Anyone importing a tripod for sale in the US with the purpose of having a camera on top will have to pay the piper. You can use a wooden chair or a stack of bricks but not a tripod ( a 3 legged apparatus).

This seems pretty crazy to me, too. It doesn't make much sense to me that you can have a patent on how something is to be used.

You all are trying to apply common sense to the situation, that's why you find it incredible. Common sense has nothing to do with how all the business world works. And the ITC situation is far worse than most people think. Already own an LED panel? No problem till its time to try to get it fixed. Companies won't even be able to import components from overseas like spare LEDs, dimmers, power supplies, etc. You have till Oct 17 to make your voice heard at the US ITC. Comments here or on other boards don't affect or help anything at all. You must actually send in a comment to them to make it heard.

My comment is in.

Oh, by the way, if the worse happens as the outcome, I can always write and sell a detailed instruction book ( hard copy or online pdf ) on how to build your own ( campfire LED lantern ) along with a list of US suppliers of quality components that are far better built cheaper too. No importing, all US made and best of all... you can also use it as a...shhhhhhh.....VIDEO LIGHT.

Support, haha~~ We have more other ways to do better.

The main hearing happened in June already. They are in the preliminary decision phase, that's why the last chance for soliciting comments from the public until yesterday. The judge has been leaning towards granting the ban on imports of LED lighting from overseas. This, despite all the evidence that was presented which was quite good. Appeals will be coming up soon no doubt among other things.
