Is MPEG-4 compression considered a "proprietary codec"??

I'm sending in my submission for the intel Atomfilms contest.

It says you can't use a proprietary codec, only Indeo or Cinepak, but when I compress in those, it looks like ****. Uncompressed is too big for a 700mb CD.

I would imagine a proprietary codec would be something like vp6 as as opposed to an open standards codec like mpeg2 DVD or mpeg4, etc.
