My CD on iTunes and Rhapsody

Well -- two years in the making and it's finally there.

Some of you might remember me heading up to Vancouver to get with Edward James Olmos to do the narration for a CD of mine.

MY DAY WITH EDDIE

That was last July and the CD came out in December. Now it's on

Now -- I must say... I make absolutely NO money on this. These were picked up thru the freedom of information act by Altissimo Records and I have had NO control of the distribution digital or otherwise. How they can claim a copyright on something they 'stole' is beyond me.

BUT -- I'm glad it's out there!!!

iTunes doesn't work in Linux, so I can't check it out myself, but one question:

Do the downloads have DRM? Because if they do, that's about as ironic as it gets: selling a copy of someone else's work (to whom you give no compensation), and then crippling the content with DRM so that the person who pays for it can't use it as they like...

Even if the Freedom of Information act lets them use the recording as they like, there shouldn't be anything keeping you from doing the same -- why not pitch the same content to another label?

There is a very large portion of Law called Ethics. Although it might sound subjective and the fact than NOBODY really understands ethics law - even ethics law lawyers... the fact is, I cannot make any money with any talents I utilize in the service of my country for profit or gain.

Now -- that said, were Major Michael Mench asked to come out and conduct a symphony orchestra and they asked me because I conduct an AF Band I'd have to either do it for free or decline. If they asked Michael Mench because they happened to remember me as a High School band director and thought I might have talent 10 years ago and haven't seen my work since... well -- I'll take $5k a night thank you.

Here's where it gets tricky -- IF they ask me because they've seen and heard my work but still want me to do it as Michael Mench and don't mention in my bio WHAT I do in the AF - only that maybe I AM in the AF... then it's $5k a night thank you... but I'll still have IRS climbing up my butt... but it is legal.

So - yes... I can NEVER make any money off this CD. Nor do I personally want to. I did it with American Taxpayer money - like everything else we do. Nothing wrong with it - it's a force multiplier for us. We had a very limited distribution (I've still got some in the office) to civic and military leaders, community libraries in our touring area, college band directors (for recruiting) and radio stations around the country.

We continue to give them away to the few who ask us at our concerts, though I usually say no more times than yes... else I'd be giving them ALL away.

Ever wonder why Presidents' pets write the books while they're in office?

Ethics.

Congratulations, Major. As you already know, don't fret about the business side of it. Having a CD available to the mass public is a huge accomplishment. Enjoy it.
