Music use...

Hi guys,
I made a short video clip of my Bro about the Pro-Drive boat motor that shows its capabilities on ice, mud, stumps, and the like.

Well he posted it on the web and the company got a hold of it and wanted a copy, so my Bro mailed them a copy and now they want it on their website but they are worried about the legality of the sound track. They are worried they will get sued, but I was thinking the video won't be sold and is just a customer clip. Do i need to get rights to the music if its just for fun???
Thanks for any feedback, I'll post a link to the short vid, it was just for fun so the quality is crap but the company is based out of Alabama and they don't have ice down there so they loved it!!!

yes yes yes.. the company is using it as a sales tool which deems it commercial which means you must get rights. But call the rights holder, you may get away with paying $100.

Adding a royalty free track is an easy solution. You'd be surprised what you can get. I used a low budget hip-hop track once and recently heard the same clip on latest NBA Dunks DVD -- cheap bastards ;)

even if it is not for commercial use, there are 6 exclusive rights of the copyright holder. One of them is the right to reproduce (no matter what the purpose), and one is performance by digital transmission.

oh, so I am really in the wrong for just making a private video that gets put on the net by some one else??? **** man...I'll have to be more careful...any of you guys ever use the www.soundtrax.mu ???

Thanks for the help!
