I have a question regarding music that we do not have copyrights for...

Are we able to use only 5+or- secs or a melody from a copyrighted song even though we re-played it without copyrights?

Also how much of a song do you change or re-create to pass the copyrights, I heard it was half of the song at minimum...

First question: No, you must have permission from the copyrightholder for ANY amount of the recognizable song.
Second question: George Harrsson was successfully sued for 3 notes.
