Local News Grief

Just completed a full feature screen play. Based on a true story and we're using local news footage to present to investors and possibly a teaser. My question is, channels 2 and 7 gave us the ok. But channel 4 denied our request for a lowzy 8 seconds. If we do not use this footage in the film but rather to advertise the movie, is that illegal? I've thought of reinacting the scenes but it's so authentic. Story took place nearly 20 years ago.

I hate to even say this in public, but seriously, are they even going to know? If you present it to investors, that's a pretty small group of people. If you post it on you tube - that's a different story.

I personally would run with it on the basis that the project might never see the light of day. If it becomes big and famous, pay them whatever they want.

To answer your question, it's illegal. Technically.

just my $.02

I've decided to add a link to the teaser.

The footage was taken from a very old VHS tape that I captured in 2k @ 23.98. Since we are working in 2k I figured the quality would hold up better to record it in than to stretch 480.

Not legal. And, since you asked them, they know about it. And, since they denied you permission, you know about it, so "whoopsie" isn't even a defense if the time comes.

Not to mention that you posted here, and were told it wasn't legal - then went ahead and used it anyhow.

BUT - regardless of all that, interesting trailer.
I can see why you wanted to use the footage.

I have not launched the site with the teaser. I uploaded on to youtube just to get feedback. I can always remove it. However, I talked to a friend at the local channel. If anything, I have to remove the Chris Hanson section (4 seconds). As far as the "700 sticks of dynamite" He said that would be ok to use. Once again just to clarify, this will not be used in the actual movie.

OK, so after going back and fourth for months and being denied by channel 4. My buddy decided to contact NBC headquarters. Guess what? After the pricks locally didn't want to help we ended up getting it straight from NBC. They were great and understanding. It's not confirmed yet but from the looks of it. I think I got it! :Drogar-BigGrin(DBG)
