Legal question...

The copyright runs from creation on the original pix, so they would be public domain. However, if the magazine did something to them, they could probably claim copyright on them as their derivative work.

As always, it's circumstantial; don't trust anything from a message board; if you're not sure, ask a lawyer and supply as much factual detail as you can.
