LAW aobut shooting without the permit...

Hi,

I got this info from shootingpeople.com (you can become a member and get one email a day with job, tips etc) and probably it's worth sharing with shooting brothers. And sisters ;D SO this is the info:

""Oh-kay. Someone had to look this up, so, being a retired lawyer, I volunteer.
Here's the skinny:

Section 1050.9(c) of the New York City Transit Adjudication Bureau Rules says
“Photography, filming or video recording in any facility or conveyance is
permitted except that ancillary equipment such as lights, reflectors or
tripods may not be used. Members of the press holding valid identification
issued by the New York City Police Department are hereby authorized to use
necessary ancillary equipment. All photographic activity must be conducted in
accordance with the provision of these Rules.” So it seems that you only need
a permit if you're using lights, reflectors or tripods.

As to the penalties for violating this rule, Rule 1050.10 says, “Pursuant to
section 1204(5-a) of the Public Authorities Law, any person committing one or
more violations of these rules shall be subject to either:
(a) criminal prosecution in the criminal court of the City of New York, which
court may impose a fine not to exceed twenty-five dollars or a term of
imprisonment for not longer than ten days, or both; or (b) civil penalties
imposed by the transit adjudication bureau in an amount not to exceed one
hundred dollars per violation (exclusive of interest or costs assessed
thereon).

"1. The schedule of such civil penalties will be set forth in an internal
procedure manual of the transit adjudication bureau and may be revised from
time to time, including provisions for repeat offenses.

"2. In addition to a civil penalty for one or more violations of these rules,
an additional penalty, not to exceed fifty dollars, may be imposed upon the
failure of a respondent in any proceeding commenced with respect to any such
violation to make a timely response to or appearance in connection with a
notice of violation or order issued by the Authority in such proceeding."

Re: LAW aobut shooting without the permit...

Anything to give out tickets nowadays...

Speaking about laws:

I've often come across different variations of the Third Person/Party rule where you are not allowed to videotape anybody without their consent. But I often have to and am even encouraged to because many of the bands I shoot would like to see footage of the fans. Now, depending on which venue I'm at, I'm either allowed to or not allowed to film fans. What about filming people crossing the street in front of your house? Do the same rules apply? I thought about obtaining consent but how am I going to get hundreds of people to sign a piece of paper? How do the big boys do it(see Nickelback's live videos)? Is this a venue specific rule?

Can anyone clear this up or shed any light on this?

Re: LAW aobut shooting without the permit...

I know that R.Rodrigez when shooting El Mariachi put signs in English on the street that anyone who doesnt want to be filmed should not enter :) - anyway he shot crowd on the streets and it looks like Columbia Pictures did not complain about hundreds people on the screen without signed forms.

Today I asked the police guy if I can shoot in Times Square...he said You can but dont use tripod or lights.
I am going to shoot my first feature in a month in NYC and I hope if it get distributed I will not have to contact all those turists who are going to appear on the screen ;D

I cant afford insurance now so this is the only way for me.

When in doubt, call your local film office. All major cities have a film office. In some states it could be the State Tourism office. I will be calling the one here in Philly about the use of permits soon. As for the consent thing....I have no answer on that because like you said, getting everybody to sign a release would be crazy. I was also told that you could not show buildings or recognizable stores without their permission as well. I was told that you could show an actor or someone walking from or two the business but it would have to be a tight shot not to show the whole thing in a wide shot. Now if you have permission to film the business then by all means shoot a wide shot if you need to.

thanks for that website I plan to check that out.

To maybe answer Contact Therapy's question:

I know at alot of events that require a ticket to get in (i.e. a baseball game, or Nickelback concert) there is often a disclamer of sorts on the back of the ticket saying that "by purchasing this ticket you allow any broadcasting companies in the area to videotape/broadcast your image". Okay, that's not the exact legal wording, but you get the idea.
