Is there a lawyer in the house?

This kind of thing drives me absolutely NUTS! And I see it all the time. After I took this pic I went to a restaurant with some friends and the menu had the same mistake in it. I got so mad I lost my appetite and didn't order anything. I know most people would dismiss it or ignore it or think "I know what they mean". I know what they mean too.

Does anyone know the (Michigan) law (I know there is one) that states a merchant MUST sell an item for the advertised price?

I'm not trying to get a slice of pizza or some jerky for under a penny, I'm trying to make a point. I just want to call one of these idiots out for once instead of biting my tongue.

I have played one on a film, does that count? My point here is, on a forum, you cannot trust what you are told. Legal advice online is as good as what you paid for it. If it is that important, which I don't think it is for you, ask an actual attorney.

This recent thread reveals the fact that there are at least two attorneys in the house.

Here in Israel, merchants must charge the price that is on a sticker affixed to a product. As a result, many stores don't bother with showing prices. I quickly exit such stores. Large supermarkets, however, are relatively good about pricing and yes, I do buy every last one on the shelf when they make an error which happens to be a deal for the customer. I rationalize this by thinking of how when many of these stores place an item on sale (e.g. 20% off, or buy two get one free), they first raise the price. Usually, the savings turns out to be quite modest but occasionally, the result is a higher cost! They must think we're all idiots.

In your case, I would say that if this is an honest business which offers a good product at a fair price, and doesn't attempt to fool its customers, you may wish to let it slide. But if they are predatory, find out the law and smack them.

The law generally allows for mistakes. It's different if they do it constantly, but it's easy to make a mistake. No reason to get worked up about it. Retail workers are people, too, and most of them don't want to be there.

What you do is call the Michigan department of weights and measures. They'd be able to tell you more on this situation.

So, I've already been called a "huge (you know what)" about this. Some posters are just as passionate about calling me out on my rudeness as I am about this. Fine. I figured some people would read my post and think "...this guy needs to get a life..."

Maybe.

This just happens to be one of my big pet peeves and I see it constantly. It's easier to forgive if it's on a whiteboard advertising the soup-of-the-day or a marquee that can change daily, but when it's printed and distributed professionally on a menu or vinyl banner with 4' letters, I can't help but wonder how many hands it went through with no one fixing it.

Maybe I went too far calling them "idiots", but I don't mean the cashier or waiter- I know they're not responsible. I'm just so tired of seeing things that reflect a lack of attention to detail or a lack of being conscientious or just a plain lack of an education. I feel the same way when I read a resume from a person with a college degree that reads like it was written by a 7th grader. Even if that person has, say, a mechanical engineering degree who can't write for crap, he should at least know that and have someone else proofread it for him.

Maybe I just wanted someone to commiserate with me.

I know, I know- I'm a huge jerk and I've got issues.

*Rant mode off*

Mos times I've pointed out price discrepancies to the clerk I'm purchasing something from, they give me the price on the tag (the lower one) I scored a nice red wings jersey for $50 less than it's real value because it was improperly tagged.

There is also a 'scanner law' of some kind that exists in MI... if an item scans in at the wrong price, and you pay for it, then take your receipt back in and prove it was marked at a lower price, not only will you get the difference, but I think you will get $5 as well. I've done this before, but it was a few years ago, it may have changed and there are probably some other stipulations that go along with it.

I'm not going to sue anyone. But if I want to man up and talk to the owner I would need to know the commerce law that gives his customers an unfair advantage, wouldn't I?

You could have simply stated that he may have made a mistake and moved on.

Instead you were so upset over it that you didn't say a word, chose not to eat anything and then got on here to ask for advice from a lawyer.
Looking to go back and argue the point further.

My advice, get over it.

Not doing anything to begin with and not eating was certainly well beyond what I would consider a suitable reaction.
I can only imagine what would happen if it was something serious.

I won't go back and forth with you about it. You obviously see this as something almost personal.
Even though it's not.

Just talk to the manager/owner. You don't need to point out any laws. If something is marked as 59/100ths of a cent when it's supposed to be $.59, you don't need to lawyer up if you're just trying to point out a pricing error and the potential headaches it could cause for him.

Let me get this straight; you are upset that they were charging .59cents for what apparently is a piece of shriveled up poop?

This cracked me up. I'm literally laughing out loud. My wife is looking at me like I'm crazy. Thanks for the laugh Rick.

My thoughts exactly. What the hell is that in there?
