We have the same debate here in Aust - regardless of what people in the industry say is the standard - it's the Tax dept that decides. Like the IRS there are fairly definitive tests to determine status. I've written a contract for my sub-contractors that covers all the points that the dept looks for
does the sub contractor supply their own tools, are they responsible for making good on faulty work, etc etc. it's not realistic but it covers all the bases if they come a knockin - I hope it works
