image rights question

Hypothetical:

If you go to a public art gallery and take a picture of an exhibit (statue) and post the image of the exhibit in your blog or a public website, are you breaking any copyright laws by not having permission to post it?

Thanks.

So a picture of a public statue or statue displayed at a public art gallery posted on a blog would be a copyright violation? I'm finding that hard to believe. Do you have any links to validate this? Thanks for the help :)

Of course the statue is protected, but when a picture of it is taken in public, how is the picture protected by the statues owner?

No, I think it is protected, just like a logo, trademark or recognizable person that might appear in your movie or other work. I would think you would need a release.

Now if your blog is "news reporting", then I would say you are coverd under fair use. Just my opinion, I'm not a lawyer.

If your usage is non-defamatory and not for-profit, it's very unlikely that anyone will object to your use of imagery of copyrighted material.

This is what I'm banking on. It's an innocuous posting of an image of the statue in a blog. No profit. Thanks guys.
