How do I deal with this situation?

Hey, so I've in a situation I don't know how to proceed with.

I normally direct music promos and other things but when a band approached me to direct them recently I said I can't as I was super busy but they kept pushing and I said ok as long as I could basically stay not too involved from the project and had the idea of doing a variety of videos, one of which, my least favourite idea, was animation, which was to be done by a friend of mine living in NYC (I'm in the UK). To my surprise the band loved the animation idea and my friend's work and wanted to do that and we agreed budgets and got the go ahead, with my animator friend taking the main role and me basically producing/co-directing from a-far.

The thing is that was a month ago and the video isn't done now, in fact my friend has, to my eyes, been either really lazy or just unprofessional and done barely any of the animation. I asked him what was going on last night on Skype and he basically described a situation where his infrastructure to make the video was taken away at the last moment and he's been trying to get things sorted but not doing a great job.

Part of me wants to punch him in the face and I don't know him to be lazy or deceitful but at the same time if I take him at his word then it might mean that despite the crappy situation things are about to change as he should now have things sorted.

Second thing thou is that the band themselves have been slack at paying me the instalments. Again, I've met them personally a few times so I know them to be nice people, but it's still not on to be so slack paying me.

Especially considering I don't want to start paying for the video and it's costs if they've not put down a good chunk of the amount yet.

So I feel I'm torn between two situations where I either don't know the full story, or if nothing else there's just people being douches.

On the one hand there's my friend who may have just been in a tough situation, or may have just been lazy. On the other hand I've a band who want footage but who haven't paid for it yet.

I don't really know what to do, as I feel like saying to my friend what the fudge are you doing, stop fudging about and get the fudging thing done, maybe in more polite terms, maybe not!

On the other hand I don't know if to push to the band and say you haven't paid yet or what.

Basically two situations where if I take things at face value them people are just being stupid or they might just be lazy or whatever but I'm in the middle!

This isn't as bad as you think it is. If the client is not paying, then I would use that as your out. Let them know that you need your payments in order to move foreward. Take that money. DON'T SPEND A DIME. Hire an animator, use the payment to get him up to speed on the project. Then tell them they will recieve the final cut when the balance is paid in full. Of course this is all contingent upon not having contracts, which it sounds like you dont. And if this is true, it may be a good thing, assuming your not past the delivery date.

music video business..

I always take a half-of-money before start shooting ( or at the day of the shooting before the start ), and the other half when prview version of final result ( watermarked, lower res ) is confirmed before giving them the final version. No money, no video.. I don't want to hear they have premiere on TV or something.. no money - no video..
they can borrow money from family/friends and give them money back later..not me..

Half money at advance..it will cover your production expences, and some of your time..

and when people pay halh of the money they won't let that so easy.. on the other hand I have a good motivation to finish the project fast as possible.. so, I will get the other half of money..

the band has seen your previous work, so they should trust you. Before shooting / editing give them scenario for confirmation, so they couln't say they didn't mean it will look like that and that they didn't know or say something. It is good to give them also contract, where all the issues will be writte; what, when, and how much..number of possible changes ( two )..and how much will you charge any additional change ( $ / day )

since I work like that, there is no problems with money or else..
