How best to proceed here with someone messing me about?

Hey,

So I had a music video planned and pitched an idea, I'm gonna try not to go too specific to avoid naming anything, but basically it involved getting something made.

I spoke to some of these 'makers' before I pitched the idea and got it accepted and was told it'd take two weeks to get it done, I even paid 200 bucks extra to get that done.

I paid for the thing to be made on 11th November, I still don't have it now. The record company in this case are friends of mine and their EP isn't out for the band until February so they've been patient as I try to explain the guy hasn't done what he's supposed so. But frankly I'm looking like a tit as this guy hasn't delivered the thing.

I don't know how to deal with the situation really. The issue is the guy is specialised so is in the USA, I'm in the UK. At first, as time went by, my emails were more encouraging, come on lets get this done etc, but now they're just frustrated and annoyed, I'm basically giving the guy a bollocking which I don't like as a motivating tool but it's what I'm left with.

I don't know if I just cancel it and ask for my money back and try to come up with someone else, say to the record company I'm sorry and see what happens with the record company, or if to just keep on at the guy until he delivers and go with that. Naturally I've done all the planning elsewhere so there's that to consider.

I do need to point out, in fairness, that the record co are a bit slack themselves and did change I secondary detail, the clothing of the thing I'm having built, a month into it, but that was over a month ago and clothing is the easiest thing to add, the making of the thing is the key issue and that was meant to, so emails said, to have been done by early December.

So what do people thing I should do here? I know I haven't given too much specific info, I'm trying not too just in case, but still advice is welcome.

What's your sense that "if" you get the project back that it will also be to your liking without any farther changes? And how does that work with your February deadline?

Well the issue is further complicated because, once I had the idea, lined up the maker etc, I pitched it as a two video deal - where the story follows across both videos, so I'd be forced to basically come up with an idea for two videos off the top of my head mostly.

The guy was meant to send me pictures of how it was so I could approve and ship, that was last Wednesday and he's not replied to my emails since then.

In scenarios like this, no news is usually not good news. Communication is key when working on a team, and even more so when collaboration is wide are or in your case, across an ocean. Do you have a phone number or other means to contact?

No I only have email, that's all the dude gave on his website and in communication to date. He's normally been ok with answering emails, slow to do the job, but ok with communication until this last week or two. That coupled with the failure to complete means this last fortnight, aka 2010, has been a very frustrating one to date.

You could try a whois search on his domain name and he actually owns it, you should get his contact details there - including phone #, etc, unless he has paid extra to have the info hidden.
