Getting a Business License...

I am going to go today to seek a Business License. Every state is different but for the most part most of my work will be out of state as far as shooting goes. All the editing will be done here in state. However, I have been told that I would need to register my company in every city, I plan to do business in. Is this true? How would they know if I went to MD to shoot something or went to VA to shoot something then came back to Delaware to edit everything? The business would be based in Delaware but most of the projects would be elsewhere.

Re: Getting a Business License...

You don't need to get an LLC or anything just open up a Business Bank Account as a SOLE PROPRIETOR...thats all you need to do...

Re: Getting a Business License...

No, Kyle, that's not all he needs to do.

Most municipalities require vendor licenses if you're going to do business in that area -- this is usually done at the county level. This is for a variety of purposes, not the least of which being taxes.

Conducting business is where you conduct the business -- as in, the transaction. If you're shooting in MD for a client in your home, you're not conducting business in MD. It's about where the money changes hands.

But as you say, every state is different -- I'd consult your state resources for the no doubt serpentine rules they have in place.

Re: Getting a Business License...

Kyle, you dont have to do anything with a bank account.. you just need to file your taxes under your business name on form c of the 1040 using your social security # for your TIN under a sole proprietorship. certain services and sales jobs require permits, but videography /filmmaking/editing are not include in that list here in WI or most states. but if you sell goods youll likely need to have a permit or license. or as david mentions if you are a business of any kind alot of times the local municipalities want you to register with them , or get some sort of permit to operate within their juristiction . such is not the case here in WI and i believe IL but you would have to check on a state to state ..even city/ county somtimes basis as David said

Re: Getting a Business License...

Great subject. Ok heres a few perspectives...
1. Im a loan officer for a mortgage company(call me if interested i need the cash) :)
Anyways
Want to refi your house or purchase new? Self employed? Ok your self employed you need to refinance or purchase. Your credit scores are good .. You will need to do a stated income program if your not showing a profit on your taxes. Meaning that you have to say hey "bank" Im self employed and dont show any income. So I want to say I make maybe 6,000$ a month so that my ratios factor out satisfactorily and then all i need to get my loan approved is a "BUSINESS LISCENSE" and a letter from your CPA saying im self employed and he or she has prepared my tax returns for "2" years.

Ok loser is right. Some states dont neccesarily liscense everybody. and that can be a good thing? A liscense is a tax used to regulate commerce and generate revenue. Ok so i have my business liscense. The state knows im there they got their nose right in it.. kinda like automobile liscenses same deal.

Ok Kyle your somewhat right also.. I like the idea of kinda staying under the radar.. If your not pulling down 6 figures then theres really no need to set out and find someone to liscense and regulate you. The dog catcher gos door to door asking if you have pets and then writes you a ticket if you do and they arent liscensed. saw that on the news here in KS thought i would share it.

Call your business your business name + .com is another loophole I believe (might be wrong) so if im a .com an internet business I believe im exempt form federal taxes. States on the other hand and especially kansas where im from are all over this and trying everything to tax sales made in state despite being internet related.

Stay small until you get big then get big... i guess thats my philosophy. I think David is an attorney or something though and he will think like attornies do .... CYA.. cover your ass.. wanted to put that in Dave to not take away from or undermine your advice.. ;) ;D
