Ehh, the post is from November. Those things happen, but I'm not sure this is that.

While obviously this is a very dick thing to do, and it would be very justifiable for other films to not hire him, does this really break the NDA? He didn't speak about a single detail about the film, only that he thought it sucked. That seems like a very vague line to try and push in court.
