Copywrite and Distribution Rights - What Do You do?

Just getting up and running here and find that I'm getting a lot of work producing DVD's of performances by Dance Companies and Musicians etc. Usually I'm asked to make about 20 copies so everyone involved gets a copy and they can use them to apply for funding. I charge a rate for producing one DVD which covers acquiring footage, post production and design, and then agree a bulk rate for an agreed amount of DVD's produced after that.

Invariably, after a good gig, members of the audience come up to me asking if they can buy a copy and I usualy refer them back to the company producing the show. Thing is... if I sell directly to the public, I could charge a lot more for the DVD's. And if I advertised at the gig, I could make more again.

I know I just need to clear it with my clients beforehand... but before I get down to it with any of them.. I'd love to know how you more experienced folk handle it.

And also... do I automaticaly have copywrite on the DVD's I produce. If there is no contract, am I free to use the footage for my own marketing without seeking permission?

Thanks!

Who owns the content that you are shooting as far as music and performance? This sounds like a work for hire with no contract in place - there should be something in place regardless of whether you can sell or not - just to cover your ass. Find out who owns the rights to the content, then work from there.
